BILL NUMBER:S5652 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to establishing a residential parking system in the city of Troy PURPOSE OR GENERAL IDEA OF BILL: Provides for the city of Troy to adopt a residential parking permit system. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends the vehicle and traffic law by adding a new Section 1640-o, which would allow the city of Troy, by adoption of local law or ordinance, to provide for a residential parking permit system within the areas designated by the city of Troy Section 2 provides the effective date JUSTIFICATION: Parking in neighborhoods such as downtown Troy has become increasingly prohibitive for residents and local businesses alike. This legislation authorizes the Troy City Council to adopt a residential parking permit system for the city of Troy in the Downtown Troy Business District. A residential parking permit system would alleviate the many parking and environmental issues increased by non-residents using the district as a personal and free parking space for hours each day. McDONALD -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to establishing a residential parking system in the city of Troy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 1640-o to read as follows: S 1640-O. RESIDENTIAL PARKING PERMIT SYSTEM IN THE CITY OF TROY. 1. NOTWITHSTANDING THE PROVISIONS OF ANY LAW TO THE CONTRARY, THE CITY COUNCIL OF THE CITY OF TROY MAY, BY ADOPTION OF A LOCAL LAW OR ORDI- NANCE, PROVIDE FOR A RESIDENTIAL PARKING PERMIT SYSTEM AND FIX AND REQUIRE THE PAYMENT OF FEES APPLICABLE TO PARKING WITHIN THE AREA IN WHICH SUCH PARKING SYSTEM IS IN EFFECT IN ACCORDANCE WITH THE PROVISIONS OF THIS SECTION. 2. SUCH RESIDENTIAL PARKING PERMIT SYSTEM MAY ONLY BE ESTABLISHED WITHIN THE AREA OF THE CITY OF TROY CONSISTING OF THE FOLLOWING STREETS: RIVER STREET FROM HOOSICK TO FEDERAL STREET; FEDERAL STREET FROM RIVER STREET EAST TO FIFTH AVENUE; SOUTH TO GRAND STREET; EAST TO SIXTH AVENUE; SIXTH AVENUE FROM GRANT STREET TO CONGRESS STREET; EAST TO 8TH STREET; 8TH STREET AT CONGRESS STREET WEST TO 3RD STREET AT FERRY STREET, THEN NORTH TO CONGRESS STREET, THEN WEST TO THE HUDSON RIVER; WEST; THE HUDSON RIVER FROM CONGRESS STREET TO HOOSICK STREET AT THE COLLAR CITY BRIDGE. 3. NOTWITHSTANDING THE FOREGOING, NO PERMIT SHALL BE REQUIRED ON THOSE PORTIONS OF SUCH STREETS WHERE THE ADJACENT PROPERTIES ARE ZONED FOR COMMERCIAL/RETAIL USE.
