TITLE OF BILL:

An act to amend the alcoholic beverage control law, in relation to
farm brewery licensees

PURPOSE:

To authorize farm breweries to sell wine and spirits manufactured by a
licensed farm winery or distillery.

SUMMARY OF PROVISIONS:

Section 1 amends § 51-a(2)(e) of the alcoholic beverage control law to
permit farm breweries to sell wine and spirits manufactured by any
licensed farm winery or distiller at retail for consumption on or off
a farm brewery's premises.

Section 2 provides the effective date.

EXISTING LAW:

§ 51-a of the Alcoholic Beverage Control Law authorizes the operation
of licensed farm breweries. The section provides that any person may
apply to the State Liquor Authority (SLA) for a farm brewery license

to brew beer within this state for sale. By holding a farm brewery
license, the licensee is authorized to operate a brewery for the
manufacture of New York State labeled beer and cider. The license also
authorizes the licensee to sell at their licensed brewery beer and
cider manufactured by the licensee or any other licensed farm brewery
for consumption on or off the licensed premises.

JUSTIFICATION:

Presently, farm brewers are permitted to sell at their licensed
brewery beer and cider manufactured by the licensee or any other
licensed farm brewery for consumption on or off the licensed premises.
This bill gives farm brewers an opportunity to expand their income
making potential by adding the ability to sell wine or spirits
manufactured by any New York State licensed farm winery or distillery
at retail for consumption on or off premises. This would assist both
the farm brewer and the farm wineries and distilleries in expanding
the market for their products.

AN  ACT to amend the alcoholic beverage control law, in relation to farm

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (e) of subdivision 2 of section 51-a of the alco-
holic beverage control law, as added by chapter 108 of the laws of 2012,
is amended to read as follows:
  (e)  sell  at the licensed premises beer and cider manufactured by the
licensee or any other licensed farm brewery, AND WINE AND SPIRITS  MANU-
FACTURED  BY  ANY  LICENSED  FARM  WINERY  OR  DISTILLERY, at retail for
consumption on or off the licensed premises;

authorize farm wineries to sell beer and spirits by a licensed farm
brewery or farm distillery.

SUMMARY OF PROVISIONS:

Sections 1 and 2 amend the alcoholic beverage control law, section
51(a)(2)(e) and section 76- a(2)(e) to permit farm breweries to sell
wine and spirits manufactured by any licensed farm winery or distiller
at retail for consumption on or off a farm brewery's premises, as well
as to permit wineries to sell beer and spirits manufactured by any
licensed farm brewery or distillery at retail for consumption, on or
off the farm winery premises.

Section 3 provides the effective date.

of licensed farm breweries, while section 76-a permits the operation

of licensed farm wineries. These sections provide that any person may
apply to the State Liquor Authority (SLA) for a farm brewery license
or farm winery license within this state for sale of beer, spirits,
wine or cider. By holding a farm brewery license or a farm winery
license, the licensee is authorized to operate a brewery or winery for
the manufacture of New York State labeled beer, spirits, cider, or
wine. The license also authorizes the licensee to sell their product,
manufactured by the licensee or any other licensed farm brewery or
farm winery for consumption on or off the licensed premises.
