BILL NUMBER: S6056 TITLE OF BILL : An act to amend the social services law, in relation to authorizing the payment of medical assistance for the provision of kidney transplants for certain aliens PURPOSE OR GENERAL IDEA OF BILL : This bill amends the Social Services Law, with regard to expanding available public medical assistance for kidney transplantation to include undocumented persons in New York. Where current law provides that public assistance shall cover routine dialysis treatment for undocumented persons who experience chronic renal ailments, both fiscal and moral reasons justify expanding coverage to also include kidney transplants. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends Section 365-a of the Social Services Law by adding a new subdivision 10, which would allow public medical assistance to include coverage of actual kidney transplant procedures, as well as medical aftercare services not limited to prescription drug coverage and follow-up visits to the doctor. The Section mandates that an undocumented person must undergo two years of emergency dialysis treatment in New York in order to qualify for public assistance for a kidney transplant. PERALTA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the social services law, in relation to authorizing the payment of medical assistance for the provision of kidney transplants for certain aliens THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 365-a of the social services law is amended by adding a new subdivision 10 to read as follows: 10. NOTWITHSTANDING THE PROVISIONS OF SECTION ONE HUNDRED THIRTY-ONE-K OR ANY OTHER PROVISION OF THIS ARTICLE, MEDICAL ASSISTANCE SHALL ALSO INCLUDE PAYMENT FOR SURGERY, MEDICAL CARE AND PRESCRIPTION DRUGS RELATED TO KIDNEY TRANSPLANTATION FOR ALIENS WITH END-STAGE RENAL DISEASE WHO ARE OTHERWISE ELIGIBLE FOR BENEFITS PURSUANT TO THIS TITLE. AN ALIEN SHALL ONLY BE DEEMED TO BE ELIGIBLE PURSUANT TO THIS SUBDIVISION IF HE OR SHE HAS UNDERGONE EMERGENCY RENAL DIALYSIS FOR A PERIOD OF NOT LESS THAN TWO CONSECUTIVE YEARS, AS PROVEN BY SUCH MEANS AS SHALL BE DESIG- NATED IN THE REGULATIONS OF THE COMMISSIONER OF HEALTH. S 2. This act shall take effect on the first day of January next succeeding the date on which it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized and directed to be made and completed on or before such effective date.
