BILL NUMBER: S6256 TITLE OF BILL : An act to amend the real property actions and proceedings law, in relation to notice of contact information of a plaintiff in a mortgage foreclosure action PURPOSE : To require plaintiffs in mortgage foreclosure actions to provide contact information to the municipality in which the foreclosed property is located. SUMMARY OF PROVISIONS : Section 1 amends section 1307 of the real property and proceedings law to require mortgage foreclosure plaintiffs to provide contact information of the employee or agent responsible for the maintenance of the foreclosed property to the municipality in which the foreclosed property is located. JUSTIFICATION : Due to New York State's struggling financial situation a foreclosure crisis emerged causing citizens to lose their homes. Banks foreclose on such properties leaving those dwellings vacant. Current law requires the owner of the property to maintain it. However, localities in which the property is situated allocate significant resources to inspect the foreclosed property and hand out violations if necessary. The process can be long and burdensome on municipalities since no set form of contact information of the proprietor is given to the municipality. ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the real property actions and proceedings law, in relation to notice of contact information of a plaintiff in a mortgage foreclosure action THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1307 of the real property actions and proceedings law is amended by adding a new subdivision 9 to read as follows: 9. A MORTGAGE FORECLOSURE PLAINTIFF WITH A DUTY TO MAINTAIN FORECLOSED PROPERTY SHALL PROVIDE THE CONTACT INFORMATION OF THE EMPLOYEE OR AGENT OF THE PLAINTIFF RESPONSIBLE FOR MAINTENANCE OF THE FORECLOSED PROPERTY. SUCH CONTACT INFORMATION SHALL INCLUDE, BUT NOT BE LIMITED TO, A DIRECT TELEPHONE NUMBER AND THE NAME OF THE EMPLOYEE OR AGENT OF THE PLAINTIFF RESPONSIBLE FOR MAINTENANCE OF THE FORECLOSED PROPERTY. SUCH CONTACT INFORMATION SHALL BE PROVIDED TO THE MUNICIPALITY IN WHICH THE FORE- CLOSED PROPERTY IS LOCATED THROUGH WRITTEN NOTICE TO THE CHIEF FINANCIAL OFFICER OF THE MUNICIPALITY AND SHALL BE POSTED ON ANY VACANT DWELLING OR ANY DWELLING THAT BECOMES VACANT AFTER THE ISSUANCE OF THE JUDGMENT OF FORECLOSURE AND SALE.
