BILL NUMBER: S8048 TITLE OF BILL : An act to amend the New York city civil court act, in relation to the annual fees paid by city marshals to the city of New York PURPOSE : To increase the annual assessment rate at which payment is made by the Marshals to the City of New York. SUMMARY OF PROVISIONS : Section 1. Amends subdivisions 1 and 2 of Section 1611 of the New York City Civil Court Act (CCA), as amended by Chapter 11 of the laws of 2003, which require New York City Marshals to pay annual fees, also called assessments, to the City of New York. Specifically, subsection 1, concerning the payment of a $1,500 annual fee by every City Marshal who serves in office during any part of the calendar year, is amended to provide for payment of a $2,000 annual fee by every City Marshal who serves in office during any part of the calendar year. Subsection 2 is amended to provide for an increase in the rate at which the annual payment by the Marshals to the City is computed. The rate is increased from 4.5% to 5.5% of gross fees, including poundage. JUSTIFICATION :

S T A T E O F N E W Y O R K ________________________________________________________________________ 8048 I N S E N A T E June 7, 2016 ___________ Introduced by COMMITTEE ON RULES -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the New York city civil court act, in relation to the annual fees paid by city marshals to the city of New York THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 1 and 2 of section 1611 of the New York city civil court act, as amended by chapter 11 of the laws of 2003, are amended to read as follows: 1. Every city marshal who serves in office for any portion of the calendar year shall pay an annual fee to the city of New York of [fifteen hundred] TWO THOUSAND dollars. 2. Every city marshal shall, in addition to the fee required by subdi- vision one, pay annually to the city of New York [4.50] 5.50 percent of the gross fees, including poundage, received by the marshal during the preceding calendar year. S 2. This act shall take effect immediately, provided that this act shall apply to any annual fee, or percentage of gross fees, paid to the city of New York with respect to calendar year 2016.
