SIMANOWITZ, McDONOUGH, MILLER -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to tire safety THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 35 of section 375 of the vehicle and traffic law is amended by adding a new paragraph (d) to read as follows: (D) NO MOTOR VEHICLE REPAIR SHOP AS DEFINED IN SUBDIVISION TWO OF SECTION THREE HUNDRED NINETY-EIGHT-B OF THIS TITLE SHALL REPAIR A TIRE IF SUCH TIRE, AFTER SUCH REPAIR IS COMPLETE, WOULD NOT MEET NEW YORK STATE MOTOR VEHICLE INSPECTION STANDARDS ESTABLISHED UNDER ARTICLE FIVE OF THIS TITLE. A VIOLATION OF THIS PARAGRAPH SHALL BE PUNISHABLE BY A CIVIL FINE OF NOT MORE THAN TWO HUNDRED FIFTY DOLLARS FOR EACH OFFENSE. S 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00508-01-5
