ROSENTHAL -- read once and referred to the Committee on Education AN ACT to amend the public health law, in relation to requiring certain school staff members to be trained in the Heimlich maneuver THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2500-1 to read as follows: S 2500-1. HEIMLICH MANEUVER. 1. SCHOOL DISTRICTS, BOARDS OF COOPER- ATIVE EDUCATIONAL SERVICES, COUNTY VOCATIONAL EDUCATION AND EXTENSION BOARDS AND CHARTER SCHOOLS SHALL REQUIRE AT LEAST ONE STAFF MEMBER IN EVERY SCHOOL BUILDING, FACILITY OR ANNEX TO: A. BE TRAINED IN THE ADMINISTRATION OF THE HEIMLICH MANEUVER; AND B. THAT ONE SUCH PERSON TRAINED IN THE ADMINISTRATION OF THE HEIMLICH MANEUVER BE PRESENT IN THE SAME ROOM WHILE STUDENTS EAT MEALS, INCLUD- ING, BUT NOT LIMITED TO LUNCHROOMS, MULTIPURPOSE ROOMS, AUDITORIUMS AND OUTDOOR EATING FACILITIES. 2. THE COMMISSIONER IS AUTHORIZED TO PROMULGATE REGULATIONS FOR THE IMPLEMENTATION OF THIS SECTION. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Legislative intent. It is important that teachers, adminis- trators and students in the state of New York are well informed about first aid responses to treat upper airway obstructions by foreign objects as it is reported that at least one child dies from choking on food every five days in the United States, and more than 10,000 children are taken to a hospital emergency room each year for food-choking inju- ries. It is the intent of this legislature to help prevent future deaths resulting from upper airway obstructions by expanding the choking prevention requirement of section 2500-i of the public health law, known as J.T.'s Law, by requiring public schools to post a visible poster that graphically depicts the first aid procedures used to treat upper airway obstructions caused by food or foreign objects.
