AN  ACT  to amend the environmental conservation law, in relation to the
  classification of certain dredged sediment

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Article 15 of the environmental conservation law is amended
by adding a new title 35 to read as follows:
                                TITLE 35
                    DREDGED SEDIMENT; CLASSIFICATION
SECTION 15-3501. DREDGED SEDIMENT; CLASSIFICATION.
S 15-3501. DREDGED SEDIMENT; CLASSIFICATION.
  NOTWITHSTANDING  ANY OTHER PROVISION OF LAW, MATERIAL DREDGED OR EXCA-
VATED FROM THE WATERS OF THE STATE IN ACCORDANCE WITH  A  PERMIT  ISSUED
PURSUANT  TO THIS ARTICLE OR ARTICLE TWENTY-FOUR, TWENTY-FIVE OR THIRTY-
FOUR OF THIS CHAPTER WHICH HAS BEEN CLEANED OR PROCESSED PURSUANT TO THE
PROVISIONS OF THIS CHAPTER SHALL BE  CLASSIFIED  FOR  PURPOSES  OF  THIS
CHAPTER  AS  A  BENEFICIAL  USE  MATERIAL AND SHALL NOT BE CLASSIFIED AS
SOLID WASTE.
  S 2. This act shall take effect immediately.
