CROUCH -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to authorizing peace officers and police officers to impound a vehicle when the driv- er of such vehicle fails to produce an insurance identification card THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 319 of the vehicle and traffic law, as amended by chapter 843 of the laws of 1980, is amended to read as follows: 3. Every person who operates a vehicle registered in this state, or a vehicle required to be registered in this state, shall, when required by the commissioner's regulations, produce an insurance identification card when requested by any peace officer, acting pursuant to his special duties, police officer or magistrate. The failure to so produce such a card shall be presumptive evidence that such person was operating the vehicle without having in effect financial security required by the provisions of this chapter AND SUCH VEHICLE SHALL BE SUBJECT TO IMPOUND- MENT BY ANY PEACE OFFICER, ACTING PURSUANT TO HIS SPECIAL DUTIES, OR ANY POLICE OFFICER AUTHORIZED TO IMPOUND AND STORE SUCH VEHICLE. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law.
