AN ACT to amend the executive law, in relation  to  requiring  explosive
  gas detectors in certain structures

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 378 of the executive law is amended by adding a new
subdivision 17 to read as follows:
  17. A. (I) STANDARDS  FOR  INSTALLATION  OF  EXPLOSIVE  GAS  DETECTORS
REQUIRING,  NO  LATER THAN JULY FIRST, TWO THOUSAND SEVENTEEN THAT EVERY
ONE OR TWO-FAMILY DWELLING, OR ANY DWELLING ACCOMMODATION LOCATED  IN  A
BUILDING  OWNED  AS  A  CONDOMINIUM  OR  COOPERATIVE IN THE STATE OR ANY
MULTIPLE DWELLINGS SHALL HAVE INSTALLED AN OPERABLE EXPLOSIVE GAS DETEC-
TOR OF SUCH MANUFACTURE, DESIGN AND INSTALLATION STANDARDS AS ARE ESTAB-
LISHED BY THE COUNCIL.
  (II) STANDARDS FOR THE REPORTING OF GAS LEAKS REPORTED  VIA  AUTOMATIC
TRANSMISSION  TO  A GAS COMPANY BY A GAS DETECTOR BY SUCH GAS COMPANIES.
PROVIDED, HOWEVER, THAT SUCH STANDARDS SHALL REQUIRE A  GAS  COMPANY  TO
ISSUE  AN  ANNUAL  REPORT  DETAILING  THE  NUMBER OF LEAKS RECEIVED IN A
CALENDAR YEAR DISAGGREGATED BY COUNTY.
  B. FOR PURPOSES OF THIS SUBDIVISION, EXPLOSIVE GAS DETECTOR  MEANS  AN
ALARM DEVICE THAT COMPLIES WITH THE APPLICABLE STANDARDS OF THE AMERICAN
NATIONAL STANDARDS INSTITUTE, OR ITS SUCCESSORS, FOR RESIDENTIAL DEVICES
FOR  THE DETECTION OF EXPLOSIVE QUANTITIES OF METHANE AND PROPANE GASES,
UNLESS SUCH STANDARDS ARE SUPERSEDED BY RULES ADOPTED  BY  THE  COUNCIL.
PROVIDED,  HOWEVER,  THAT  SUCH  DEVICES  SHALL FURTHER BE EQUIPPED WITH
TECHNOLOGY ENABLING SUCH DEVICES TO AUTOMATICALLY REPORT THE  OCCURRENCE
OF  EACH  GAS LEAK DETECTED BY SUCH DEVICES TO THE COMPANY PROVIDING GAS
TO THE DWELLING IN WHICH SUCH DEVICE IS LOCATED.
  C. FOR PURPOSES OF THIS SUBDIVISION, MULTIPLE DWELLING MEANS A  DWELL-
ING WHICH IS EITHER RENTED, LEASED, LET OR HIRED OUT, TO BE OCCUPIED, OR
IS  OCCUPIED AS THE TEMPORARY OR PERMANENT RESIDENCE OR HOME OF THREE OR
MORE FAMILIES LIVING INDEPENDENTLY OF  EACH  OTHER,  INCLUDING  BUT  NOT
LIMITED  TO THE FOLLOWING: A TENEMENT, FLAT HOUSE, MAISONETTE APARTMENT,
