S T A T E O F N E W Y O R K ________________________________________________________________________ 9938 I N A S S E M B L Y April 29, 2016 ___________ Introduced by M. of A. NOLAN -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to the establishment of a school certificate title for school mental health practitioners THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 55 to read as follows: 55. THE COMMISSIONER SHALL ISSUE REGULATIONS TO ESTABLISH A CERTIF- ICATE VALID FOR PUPIL PERSONNEL SERVICES AS A SCHOOL MENTAL HEALTH COUN- SELOR, SCHOOL MARRIAGE AND FAMILY THERAPIST, SCHOOL PSYCHOANALYST AND A SCHOOL CREATIVE ARTS THERAPIST. IN ADDITION TO ANY OTHER REQUIREMENT FOR CERTIFICATE ESTABLISHED IN REGULATIONS, A CANDIDATE FOR A CERTIFICATE ESTABLISHED BY THIS SUBDIVI- SION SHALL BE REGISTERED AND HOLD A VALID LICENSE PURSUANT TO ARTICLE ONE HUNDRED SIXTY-THREE OF THIS CHAPTER. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however, that effective immediate- ly the department of education is authorized to promulgate any and all rules and regulations and to take any other measures necessary to imple- ment this act on or before such effective date.
