TITLE OF BILL:  An act to amend the social services law, in relation
to directing the council on children and families to establish an
online listing and map of publicly funded or registered afterschool
and school age childcare programs and to expand the duties of the
commissioner of social services; and to amend the education law, in
relation to expanding the duties of the commissioner of education

PURPOSE:

This bill ensures the Council on Children and Families develops and
makes available through its website a listing and map of all
recipients of grants awarded or administered by the state for the
purpose of providing afterschool or summer programs, extended learning
time, or community schools, and all registered school age providers
registered by the office of children and family services.  The listing
shall include for each grant recipient or provider the recipient or
provider's name, the address at which the program is offered, and the
name and phone number of an individual who is authorized to answer
questions regarding the program.

SUMMARY OF PROVISIONS:

Section 1 amends social service law by adding section 483-g that
requires the Council on Children and Families to develop and make

available through its website a listing and map of all recipients of
competitive grants awarded or administered by the state included but
not limited to grants under section 3641 of the education law, grants
awarded or administered by the state for the purpose of providing
afterschool or summer programs, extended learning time, or community
schools, and all registered school age providers registered by the
office of children and family services. The listing shall include each
grant recipient or provider's name, the address at which the program
is offered, and the name and phone number of an individual who is
authorized to answer questions regarding the program. The listing and
map shall be updated no less than once every ninety days to reflect
changes. The listing and map shall be updated within ninety days of
any contract with a grant recipient expiring or being signed. The
council may include locations and information for additional relevant
programs as it sees fit.

Section 2 amends subdivisions (h) and (i) of section 17 of the social
services law to require that the Commissioner of Children and Families
services make available to the Council on Children and Families,
through the OpenNY website, information regarding all recipients of
grants awarded or administered by the state for the purposes of
providing afterschool or summer programs as defined in section two of
this chapter, extended learning time, including but not limited to
grants for such purposes awarded under section thirty-six hundred
forty-one of the education law, and registered school age child care
providers registered by the office of children and family services.
For each grant recipient or provider, information concerning name, the
address at which the program is offered, and the name and phone number
of an individual who is authorized to answer questions regarding the
program will be made available through the OpenNY website no less than
once a year and within 90 days of the date of execution or expiration


of contracts with grant recipients when all such contracts are
executing or expiring for a particular competitive grant.

Section 3 amends section 305 of the education law by adding a new
subdivision 53 to require the Commissioner of Children and Family
Services to provide the council information regarding all recipients
of grants for afterschool, summer programs, or extended learning time
awarded or administered by the state , including but not limited to
grants for such purposes awarded under section 3641 of this chapter,
or community schools. Each grant recipient's name, address and contact
information for a person authorized to answer questions regarding the
program. The information must be provided to the council no less than
once a year and within 90 days of the date of the execution and
expiration of grant with grant recipients.

Section 4 defines "afterschool program" and "summer program".

Section 5 establishes the effective date.

JUSTIFICATION:

As it stands now, there is no statewide database through which parents
and caregivers can search to identify afterschool, extended learning,
and summer programs for their school age children. This bill will
begin to address this gap in information and services.

AN ACT to amend the social services law, in relation  to  directing  the
  council  on  children  and families to establish an online listing and
  map of publicly funded or registered afterschool and school age child-
  care programs and to expand the duties of the commissioner  of  social
  services; and to amend the education law, in relation to expanding the
  duties of the commissioner of education

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The social services law is amended by adding a new  section
483-g to read as follows:
  S  483-G. LIST OF CHILD CARE PROVIDERS.  1. THE COUNCIL, IN ACCORDANCE
WITH INFORMATION MADE AVAILABLE TO IT BY  THE  OFFICE  OF  CHILDREN  AND
FAMILY  SERVICES  PURSUANT  TO  SECTION  SEVENTEEN  OF  THIS CHAPTER AND
PROVIDED TO IT BY THE STATE EDUCATION  DEPARTMENT  PURSUANT  TO  SECTION
THREE  HUNDRED  FIVE OF THE EDUCATION LAW, SHALL DEVELOP AND MAKE AVAIL-
ABLE THROUGH A LINK ON ITS WEBSITE:
  (A) A LISTING OF:
  (1) ALL RECIPIENTS OF COMPETITIVE GRANTS AWARDED  OR  ADMINISTERED  BY
THE  STATE  FOR  THE  PURPOSE  OF  PROVIDING:  (I) AFTERSCHOOL OR SUMMER
PROGRAMS AS DEFINED IN SECTION TWO OF THIS CHAPTER, OR EXTENDED LEARNING
TIME, INCLUDING BUT NOT LIMITED TO  GRANTS  FOR  SUCH  PURPOSES  AWARDED
UNDER SECTION THIRTY-SIX HUNDRED FORTY-ONE OF THE EDUCATION LAW; OR (II)
COMMUNITY SCHOOLS, INCLUDING BUT NOT LIMITED TO GRANTS FOR SUCH PURPOSES
AWARDED UNDER SECTION THIRTY-SIX HUNDRED FORTY-ONE OF THE EDUCATION LAW;
AND
  (2)  ALL  REGISTERED SCHOOL AGE CHILD CARE PROVIDERS REGISTERED BY THE
OFFICE OF CHILDREN AND FAMILY SERVICES; AND
  (B) A MAP DISPLAYING THE LOCATIONS OF THE AWARD RECIPIENTS AND PROVID-
ERS DESCRIBED IN SUBPARAGRAPH ONE OF PARAGRAPH (A) OF THIS SUBDIVISION.

  3.  THE  LISTING  AND MAP DESCRIBED IN SUBDIVISION ONE OF THIS SECTION
SHALL BE UPDATED NO LESS THAN ONCE A YEAR. THE  LISTING  AND  MAP  SHALL
ALSO  BE  UPDATED WITHIN NINETY DAYS OF THE DATE OF EXECUTION OR EXPIRA-

  S 2. Subdivisions (h) and (i) of section 17  of  the  social  services
law,  subdivision  (h)  as  added  and  subdivision (i) as relettered by
section 1 of part K-3 of chapter 57 of the laws of 2007, and subdivision
(i) as amended by chapter 110 of the laws of 1971, are amended  to  read
as follows:
  (h)  make  available  on its website all award allocations for request
for proposals issued by the office of children and family services  upon
release  of  such awards. Such information shall also include all organ-
izations requesting funding and the amounts requested for  each  request
for  proposal.  The  office  of  children  and  family services may also
include any other information related to  each  program  that  it  deems
appropriate[.];
  (i)  MAKE  AVAILABLE  TO THE COUNCIL ON CHILDREN AND FAMILIES, THROUGH
THE OPENNY WEBSITE, INFORMATION REGARDING: (1) ALL RECIPIENTS OF  GRANTS
AWARDED  OR  ADMINISTERED  BY  THE  STATE  FOR THE PURPOSES OF PROVIDING
AFTERSCHOOL OR SUMMER PROGRAMS AS DEFINED IN SECTION TWO OF  THIS  CHAP-
TER,  EXTENDED  LEARNING  TIME,  INCLUDING BUT NOT LIMITED TO GRANTS FOR
SUCH PURPOSES AWARDED UNDER SECTION THIRTY-SIX HUNDRED FORTY-ONE OF  THE
EDUCATION LAW, OR COMMUNITY SCHOOLS, INCLUDING BUT NOT LIMITED TO GRANTS
FOR  SUCH PURPOSES AWARDED UNDER SECTION THIRTY-SIX HUNDRED FORTY-ONE OF
THE EDUCATION LAW; AND (2) REGISTERED SCHOOL AGE  CHILD  CARE  PROVIDERS
REGISTERED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES. FOR EACH GRANT
RECIPIENT OR PROVIDER THE RECIPIENT'S OR PROVIDER'S NAME, THE ADDRESS AT
WHICH  THE PROGRAM IS OFFERED, AND THE NAME AND PHONE NUMBER OF AN INDI-
VIDUAL WHO IS AUTHORIZED TO ANSWER QUESTIONS REGARDING THE PROGRAM  WILL
BE  MADE  AVAILABLE  THROUGH THE OPENNY WEBSITE NO LESS THAN ONCE A YEAR
AND WITHIN NINETY DAYS  OF  THE  DATE  OF  EXECUTION  OR  EXPIRATION  OF
CONTRACTS WITH GRANT RECIPIENTS WHEN ALL SUCH CONTRACTS ARE EXECUTING OR
EXPIRING FOR A PARTICULAR COMPETITIVE GRANT; AND
  (J) exercise such other powers and perform such other duties as may be
imposed by law.
  S  3.  Section  305  of  the  education law is amended by adding a new
subdivision 53 to read as follows:
  53. THE COMMISSIONER SHALL PROVIDE TO  THE  COUNCIL  ON  CHILDREN  AND
FAMILIES,  IN  A FORMAT IDENTIFIED BY THE COUNCIL, INFORMATION REGARDING
ALL RECIPIENTS OF GRANTS AWARDED OR ADMINISTERED BY THE  STATE  FOR  THE
PURPOSES  OF  PROVIDING  AFTERSCHOOL  OR  SUMMER  PROGRAMS AS DEFINED IN
SECTION TWO OF THE SOCIAL SERVICES LAW, EXTENDED LEARNING TIME,  INCLUD-
ING  BUT  NOT  LIMITED TO GRANTS FOR SUCH PURPOSES AWARDED UNDER SECTION
THIRTY-SIX HUNDRED FORTY-ONE OF  THIS  CHAPTER,  OR  COMMUNITY  SCHOOLS,
INCLUDING  BUT  NOT  LIMITED  TO  GRANTS FOR SUCH PURPOSES AWARDED UNDER
SECTION THIRTY-SIX HUNDRED FORTY-ONE OF THIS  CHAPTER.  FOR  EACH  GRANT
RECIPIENT OR PROVIDER THE RECIPIENT'S OR PROVIDER'S NAME, THE ADDRESS AT
WHICH  THE PROGRAM IS OFFERED, AND THE NAME AND PHONE NUMBER OF AN INDI-
VIDUAL WHO IS AUTHORIZED TO ANSWER QUESTIONS REGARDING THE PROGRAM  WILL

BE  PROVIDED  TO  THE COUNCIL NO LESS THAN ONCE A YEAR AND WITHIN NINETY

  S 4. Section 2 of the social services law is amended by adding two new
subdivisions 39 and 40 to read as follows:
  39.  "AFTERSCHOOL  PROGRAM" SHALL MEAN A PROGRAM CONDUCTED OUTSIDE THE
REGULAR SCHOOL DAY WHEREBY STUDENTS CAN PARTICIPATE IN ENRICHMENT ACTIV-
ITIES INCLUDING BUT NOT LIMITED TO ATHLETICS, ACADEMIC ENRICHMENT,  ART,
MUSIC,  DRAMA,  ACADEMIC  TUTORING,  MENTORING,  COMMUNITY  SERVICES AND
RELATED PROGRAMS THAT WILL PROMOTE POSITIVE YOUTH DEVELOPMENT,  PHYSICAL
AND/OR  EMOTIONAL  WELLNESS,  EDUCATIONAL  ACHIEVEMENT,  AND/OR  SCHOOL,
CIVIC, FAMILY AND COMMUNITY ENGAGEMENT.
  40. "SUMMER PROGRAM" SHALL MEAN A PROGRAM CONDUCTED OUTSIDE THE  REGU-
LAR  SCHOOL  YEAR  WHEREBY STUDENTS CAN PARTICIPATE IN ENRICHMENT ACTIV-
ITIES INCLUDING BUT NOT LIMITED TO ATHLETICS, ACADEMIC ENRICHMENT,  ART,
MUSIC,  DRAMA,  ACADEMIC  TUTORING,  MENTORING,  COMMUNITY  SERVICES AND
RELATED PROGRAMS THAT WILL PROMOTE POSITIVE YOUTH DEVELOPMENT,  PHYSICAL

  S  2.  Subdivisions  (h)  and (i) of section 17 of the social services
law, subdivision (h) as added  and  subdivision  (i)  as  relettered  by
section 1 of part K-3 of chapter 57 of the laws of 2007, and subdivision
(i)  as  amended by chapter 110 of the laws of 1971, are amended to read
as follows:
  (h) make available on its website all award  allocations  for  request
for  proposals issued by the office of children and family services upon
release of such awards. Such information shall also include  all  organ-
izations  requesting  funding and the amounts requested for each request
for proposal. The office  of  children  and  family  services  may  also
include  any  other  information  related  to each program that it deems
appropriate[.];
  (i) MAKE AVAILABLE TO THE COUNCIL ON CHILDREN  AND  FAMILIES,  THROUGH
THE  OPENNY WEBSITE, INFORMATION REGARDING: (1) ALL RECIPIENTS OF GRANTS
AWARDED OR ADMINISTERED BY THE  STATE  FOR  THE  PURPOSES  OF  PROVIDING
AFTERSCHOOL  OR  SUMMER PROGRAMS AS DEFINED IN SECTION TWO OF THIS CHAP-
TER, EXTENDED LEARNING TIME, INCLUDING BUT NOT  LIMITED  TO  GRANTS  FOR
SUCH  PURPOSES AWARDED UNDER SECTION THIRTY-SIX HUNDRED FORTY-ONE OF THE
EDUCATION LAW, OR COMMUNITY SCHOOLS, INCLUDING BUT NOT LIMITED TO GRANTS
FOR SUCH PURPOSES AWARDED UNDER SECTION THIRTY-SIX HUNDRED FORTY-ONE  OF
THE  EDUCATION  LAW;  AND (2) REGISTERED SCHOOL AGE CHILD CARE PROVIDERS
REGISTERED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES. FOR EACH GRANT
RECIPIENT OR PROVIDER THE RECIPIENT'S OR PROVIDER'S NAME, THE ADDRESS AT
WHICH THE PROGRAM IS OFFERED, AND THE NAME AND PHONE NUMBER OF AN  INDI-
VIDUAL  WHO IS AUTHORIZED TO ANSWER QUESTIONS REGARDING THE PROGRAM WILL
BE MADE AVAILABLE THROUGH THE OPENNY WEBSITE NO LESS THAN  ONCE  A  YEAR
AND  WITHIN  NINETY  DAYS  OF  THE  DATE  OF  EXECUTION OR EXPIRATION OF
CONTRACTS WITH GRANT RECIPIENTS WHEN ALL SUCH CONTRACTS ARE EXECUTING OR
EXPIRING FOR A PARTICULAR COMPETITIVE GRANT; AND
  (J) exercise such other powers and perform such other duties as may be
imposed by law.
  S 3. Section 305 of the education law  is  amended  by  adding  a  new
subdivision 55 to read as follows:
  55.  THE  COMMISSIONER  SHALL  PROVIDE  TO THE COUNCIL ON CHILDREN AND
FAMILIES, IN A FORMAT IDENTIFIED BY THE COUNCIL,  INFORMATION  REGARDING
ALL  RECIPIENTS  OF  GRANTS AWARDED OR ADMINISTERED BY THE STATE FOR THE
PURPOSES OF PROVIDING AFTERSCHOOL  OR  SUMMER  PROGRAMS  AS  DEFINED  IN
SECTION  TWO OF THE SOCIAL SERVICES LAW, EXTENDED LEARNING TIME, INCLUD-
ING BUT NOT LIMITED TO GRANTS FOR SUCH PURPOSES  AWARDED  UNDER  SECTION
THIRTY-SIX  HUNDRED  FORTY-ONE  OF  THIS  CHAPTER, OR COMMUNITY SCHOOLS,
INCLUDING BUT NOT LIMITED TO GRANTS  FOR  SUCH  PURPOSES  AWARDED  UNDER

SECTION  THIRTY-SIX  HUNDRED  FORTY-ONE  OF THIS CHAPTER. FOR EACH GRANT
RECIPIENT OR PROVIDER THE RECIPIENT'S OR PROVIDER'S NAME, THE ADDRESS AT
WHICH THE PROGRAM IS OFFERED, AND THE NAME AND PHONE NUMBER OF AN  INDI-
VIDUAL  WHO IS AUTHORIZED TO ANSWER QUESTIONS REGARDING THE PROGRAM WILL

  S 4. Section 2 of the social services law is amended by adding two new
subdivisions 39 and 40 to read as follows:
  39.  "AFTERSCHOOL  PROGRAM" SHALL MEAN A PROGRAM CONDUCTED OUTSIDE THE
REGULAR SCHOOL DAY WHEREBY STUDENTS CAN PARTICIPATE IN ENRICHMENT ACTIV-
ITIES INCLUDING BUT NOT LIMITED TO ATHLETICS, ACADEMIC ENRICHMENT,  ART,
MUSIC,  DRAMA,  ACADEMIC  TUTORING,  MENTORING,  COMMUNITY  SERVICES AND
RELATED PROGRAMS THAT WILL PROMOTE POSITIVE YOUTH DEVELOPMENT,  PHYSICAL
AND/OR  EMOTIONAL  WELLNESS,  EDUCATIONAL  ACHIEVEMENT,  AND/OR  SCHOOL,
CIVIC, FAMILY AND COMMUNITY ENGAGEMENT.
  40. "SUMMER PROGRAM" SHALL MEAN A PROGRAM CONDUCTED OUTSIDE THE  REGU-
LAR  SCHOOL  YEAR  WHEREBY STUDENTS CAN PARTICIPATE IN ENRICHMENT ACTIV-
ITIES INCLUDING BUT NOT LIMITED TO ATHLETICS, ACADEMIC ENRICHMENT,  ART,
MUSIC,  DRAMA,  ACADEMIC  TUTORING,  MENTORING,  COMMUNITY  SERVICES AND
RELATED PROGRAMS THAT WILL PROMOTE POSITIVE YOUTH DEVELOPMENT,  PHYSICAL
AND/OR  EMOTIONAL  WELLNESS,  EDUCATIONAL  ACHIEVEMENT,  AND/OR  SCHOOL,
CIVIC, FAMILY AND COMMUNITY ENGAGEMENT, AND SHALL NOT  INCLUDE  REQUIRED
SUMMER  SCHOOL PROGRAMMING PURSUANT TO SECTION THIRTY-SIX HUNDRED TWO OF
THE EDUCATION LAW.
  S 5. This act shall take effect on the ninetieth day  after  it  shall
have become a law.
