BILL NUMBER:S1674 TITLE OF BILL: An act to authorize the board of cooperative educational services for the sole supervisory district of Broome, Delaware and Tioga counties to convey certain real property acquired by gift PURPOSE OF BILL: This bill would permit the Broome, Delaware and Tioga BOCES to convey certain real property acquired by gift. This bill would allow BOCES for the Sole Supervisory District of Broome, Delaware and Tioga Counties to convey certain real property acquired by gift without a public vote. SUMMARY OF PROVISIONS: Section 1 allows BOCES for the Sole Supervisory District of Broome, Delaware and Tioga Counties to convey certain real property acquired by gift without a public vote. Section 2 outlines that proceeds shall be invested and held in accordance with Article 2 of the General Municipal Law. JUSTIFICATION:

LIBOUS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to authorize the board of cooperative educational services for the sole supervisory district of Broome, Delaware and Tioga counties to convey certain real property acquired by gift THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the board of cooperative educational services for the sole supervisory district of Broome, Delaware and Tioga counties may convey for fair market value as determined by the board of cooperative educational services for the sole supervisory district of Broome, Delaware and Tioga counties, certain real property acquired by gift in 2004 without a public vote thereon. S 2. The proceeds of the sale shall be invested and held in accordance with article 2 of the general municipal law and shall be applied to reduce the capital portion of the budget of the board of cooperative educational services for the sole supervisory district of Broome, Dela- ware and Tioga counties in the fiscal year of the sale of the real prop- erty and in each of the four consecutive fiscal years thereafter.
