BILL NUMBER:S1997 TITLE OF BILL: An act to amend the administrative code of the city of New York and the general municipal law, in relation to patient protected health information PURPOSE: To prohibit the sale of patient-protected health information without the consent of the patient. SUMMARY OF PROVISIONS: Section 1 of this bill amends the Administrative Code of the City of New York by adding a new section, 15-130, which prohibits the Fire Department of the City of New York from offering for sale, selling, or distributing patient protected health information except when the patient expressly authorizes such disclosure and consent in a separate, stand-alone document. This provision shall not apply to patient information transmitted to insurance companies necessary to process an insurance claim. Section 2 of this bill adds a new section 122-a to the General Municipal Law that would prohibit emergency service providers from offering for sale, selling, or distributing patient protected health information except when the patient expressly authorizes such

GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Cities AN ACT to amend the administrative code of the city of New York and the general municipal law, in relation to patient protected health infor- mation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The administrative code of the city of New York is amended by adding a new section 15-130 to read as follows: S 15-130 PROHIBITING THE SALE OF PATIENT PROTECTED HEALTH INFORMATION. THE DEPARTMENT SHALL NOT OFFER FOR SALE, SELL, OR OTHERWISE DISTRIBUTE PATIENT PROTECTED HEALTH INFORMATION EXCEPT UPON EXPRESS WRITTEN AUTHOR- IZATION BY SUCH PATIENTS. SUCH DISCLOSURE AND CONSUMER CONSENT SHALL BE GIVEN IN A SEPARATE, STAND-ALONE DOCUMENT AND CONSENT SHALL BE LIMITED TO THE PARTICULAR USE OR TRANSACTION FOR WHICH CONSENT IS GIVEN. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO PATIENT INFORMATION TRANS- MITTED TO AN INSURANCE CARRIER NECESSARY TO PROCESS INSURANCE CLAIMS. S 2. The general municipal law is amended by adding a new section 122-a to read as follows: S 122-A. PROHIBITING THE SALE OF PATIENT PROTECTED HEALTH INFORMATION. BILL NUMBER:S1997A TITLE OF BILL: An act to amend the public health law, in relation to the protection of private patient information by ambulance services PURPOSE: To prohibit the sale of patient-protected health information. SUMMARY OF PROVISIONS: Section 1. Defines "individual identifying information" as information identifying or tending to identify a patient. This section also defines "marketing." Marketing means, but is not limited to, advertising, detailing, marketing, promotion, or any activity that is intended to be or could be used to influence business volume, sales or market share or evaluate the effectiveness of marketing practices or personnel, regardless of whether the beneficiary of the marketing is a governmental, for-profit, or not-for-profit entity. Section 2. Adds a new section 3006-a to the public health law to cover patient privacy. 3006-a provides that no ambulance service, advanced life support first response service, or employee, member or agent shall disclose, sell, transfer, exchange or use any individual identifying information to any person or entity for the purpose of marketing.

Section 3001 of the public health law is amended by adding two new subdivisions 22 and 23 to read as follows: 22. "INDIVIDUAL IDENTIFYING INFORMATION" MEANS INFORMATION IDENTIFYING OR TENDING TO IDENTIFY A PATIENT. 23. "MARKETING" MEANS, BUT IS NOT LIMITED TO, ADVERTISING, DETAILING, MARKETING, PROMOTION, OR ANY ACTIVITY THAT IS INTENDED TO BE OR COULD BE USED TO INFLUENCE BUSINESS VOLUME, SALES OR MARKET SHARE OR EVALUATE THE EFFECTIVENESS OF MARKETING PRACTICES OR PERSONNEL, REGARDLESS OF WHETHER THE BENEFICIARY OF THE MARKETING IS A GOVERNMENTAL, FOR-PROFIT, OR NOT- FOR-PROFIT ENTITY. S 2. The public health law is amended by adding a new section 3006-a to read as follows: S 3006-A. PATIENT PRIVACY. 1.
