  printed to be committed to the Committee on Local Government

AN ACT to amend the general municipal law, in relation to requiring  the
  production  of  a photographic image of each violation of a local law,
  ordinance or code relating to sanitation

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  general  municipal  law  is  amended by adding a new
section 137 to read as follows:
  S 137. PHOTOGRAPHIC IMAGES OF SANITATION VIOLATIONS.  NO  AGENT  OF  A
CITY, TOWN, VILLAGE OR COUNTY SHALL CHARGE ANY PERSON WITH THE VIOLATION
OF  ANY  LOCAL LAW, ORDINANCE OR CODE RELATING TO SANITATION, UNTIL SUCH
AGENT SHALL HAVE CAUSED A PHOTOGRAPHIC IMAGE OF THE UNSANITARY CONDITION
TO BE PRODUCED. TWO COPIES OF EACH  SUCH  PHOTOGRAPHIC  IMAGE  SHALL  BE
PRODUCED,  WITH  ONE SUCH COPY BEING ATTACHED TO THE INSTRUMENT CHARGING
SUCH VIOLATION WHICH IS PROVIDED TO THE PERSON ALLEGED TO HAVE COMMITTED
THE VIOLATION, AND THE REMAINING COPY SHALL BE  RETAINED  BY  THE  CITY,
TOWN, VILLAGE OR COUNTY.
  S  2.  This  act shall take effect on the ninetieth day after it shall
have become a law.
