BILL NUMBER:S2970 TITLE OF BILL: An act to amend the general business law and the civil practice law and rules, in relation to licensing of appearance enhancement businesses PURPOSE: To increase constraints on unlicensed appearance enhancement businesses (day spas) within this state and on day spas which violate the terms of their licenses. SUMMARY OF PROVISIONS: Section 1 of this bill amends Section 400 of the General Business Law by adding a new subdivision 11, to incorporate the federal definition of "related person" (from section 465 of the Internal Revenue Code). Section 2 of this bill amends section 410 of the General Business Law to add prostitution offenses as grounds for suspension or revocation of a license and imposition of a fine on nail specialists, natural hair stylists, estheticians, cosmetologists or appearance enhancement businesses. This amendment will also eliminates the ability to issue a reprimand when there has been a criminal act after issuance of a

Section 400 of the general business law is amended by adding a new subdivision 11 to read as follows: 11. "RELATED PERSON" MEANS A "RELATED PERSON" AS SUCH TERM IS DESCRIBED PURSUANT TO SUBPARAGRAPH (C) OF PARAGRAPH THREE OF SUBSECTION (B) OF SECTION FOUR HUNDRED SIXTY-FIVE OF THE INTERNAL REVENUE CODE. S 2. Subdivision 1 of section 410 of the general business law, as added by chapter 509 of the laws of 1992, is amended to read as follows: 1. Suspension and revocation of licenses; fines; reprimands. A license issued pursuant to this article may be suspended or revoked, or a fine not exceeding five hundred dollars payable to the department may be imposed for any one or more of the following causes: a. Fraud or bribery in securing a license or permission to take an examination therefor. b. The making of any false statement as to a material matter in any application or other statement or certificate required by or pursuant to this article. c. Incompetence or untrustworthiness. d. Failure to display the license as provided in this article. e. Violation of any provision of this article, or of any rule or regu- lation adopted hereunder. SUCH LICENSED PREMISES SHALL ALSO POST THE TOLL-FREE NUMBER, ADDRESS AND OTHER PERTINENT INFORMATION AS DETERMINED AND REQUIRED BY THE SECRETARY OF THE NATIONAL HUMAN TRAFFICKING RESOURCE CENTER IN AN AREA EASILY OBSERVABLE TO PATRONS, EMPLOYEES AND VISITORS. The department shall prepare and furnish such [sign] SIGNS to each licensee. S 2. BILL NUMBER:S2970B TITLE OF BILL: An act to amend the general business law, in relation to licensing of appearance enhancement businesses PURPOSE: To provide the Secretary of State with greater authority to address instances of human trafficking and prostitution that may occur at licensed appearance enhancement businesses. SUMMARY OF SPECIFIC PROVISIONS: Section one of this bill requires posting of the toll-free number, address and other pertinent information as determined and required by the Secretary of the National Human Trafficking Resource Center in an area easily observable to employees of a licensed appearance enhancement business. Section two of this bill provides that a license may be revoked or suspended or a reprimand may be issued if the licensee is convicted of certain prostitution offenses under the Penal Law (promoting prostitution in the third degree, promoting prostitution in the second degree, and promoting prostitution in the first degree) that occur at the licensed premises. The Secretary of State would have the discretion to place reasonable conditions on a reinstated or reissued license, including restrictions on the hours of operation of such business.
