BILL NUMBER:S4253 TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to certain reimbursements for the provision of ambulance and fire response PURPOSE: This bill will require the Palisades Interstate Park to reimburse volunteer ambulance companies and volunteer fire companies that render services to property owned by the Palisades Interstate Park. SUMMARY OF PROVISIONS: Section 1: Amends Parks, Recreation and Historic Preservation Law section 9.05 by adding a new subdivision 3-a to reimburse volunteer ambulance companies and volunteer fire companies for services rendered in the Palisades Interstate Park. JUSTIFICATION: Volunteer ambulance companies and volunteer fire companies in Orange and Rockland Counties render a tremendous number of services to the Palisades Interstate Park, often in support of visitors from outside the region and state. LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to certain reimbursements for the provision of ambulance and fire response THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 9.05 of the parks, recreation and historic preser- vation law is amended by adding a new subdivision 3-a to read as follows: 3-A. REIMBURSE ANY VOLUNTEER AMBULANCE COMPANY AS DEFINED IN SUBDIVI- SION TWO OF SECTION THREE OF THE VOLUNTEER AMBULANCE WORKERS' BENEFIT LAW OR ANY VOLUNTEER FIRE COMPANY AS DEFINED IN SUBDIVISION TWO OF SECTION THREE OF THE VOLUNTEER FIREFIGHTERS' BENEFIT LAW FOR THE PROVISION OF ANY FIRE OR OTHER EMERGENCY SERVICES RENDERED BY SUCH VOLUNTEER AMBULANCE COMPANY OR VOLUNTEER FIRE COMPANY IN THE PALISADES INTERSTATE PARK BY SUCH AMBULANCE COMPANY OR FIRE COMPANY. FOR THE PURPOSES OF THIS SUBDIVISION, THE VALUE OF SERVICES FOR A PARTICULAR ACCIDENT OR INCIDENT SHALL BE ESTABLISHED BY THE VOLUNTEER AMBULANCE COMPANY OR THE VOLUNTEER FIRE COMPANY, BY CONSIDERATION OF SALARIES, BENEFITS AND TIME OF PERSONNEL ASSIGNED TOGETHER WITH THE PRO RATA EXPENSES OF PRODUCTS, VEHICLES AND EQUIPMENT UTILIZED. STATEMENTS OF QUALIFYING CLAIMS SHALL BE SUBMITTED BY THE VOLUNTEER AMBULANCE COMPANY OR VOLUNTEER FIRE COMPANY TO THE COMMISSION WITHIN NINETY DAYS OF THE OCCURRENCE OF THE ACCIDENT OR INCIDENT. S 2. This act shall take effect immediately; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effec- tive date are authorized and directed to be made and completed on or before such effective date.
