BILL NUMBER:S4323 TITLE OF BILL: An act to amend the executive law, in relation to enact- ing the "school buildings carbon monoxide act" PURPOSE: To protect the health and safety of elementary and secondary school students by requiring installation of carbon monoxide detectors in all school buildings where the use of heating or other equipment poses a substantial risk of exposure to carbon monoxide. SUMMARY OF PROVISIONS: Section one amends Section 378 of the Executive law to provide that the New York Uniform Fire Prevention and Building Code Council shall adopt regulations requiring the installation of operable carbon monoxide detectors in every elementary and secondary school building within the state where the use of heating or other equipment poses a substantial risk of exposure to carbon monoxide. The regulations would provide that any carbon monoxide detection equip- ment installed shall be listed by a nationally recognized testing lab as meeting or exceeding American National Standards Institute/Underwriters Laboratories (ANSI/UL) standard 2075 or ANSI/UL standard 2034; and be installed in accordance with manufacturer's instructions and installa- tion requirements of national fire protection association-standard 720, 2012 edition.

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the executive law, in relation to enacting the "school buildings carbon monoxide act" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 378 of the executive law is amended by adding a new subdivision 17 to read as follows: 17. STANDARDS FOR THE INSTALLATION OF OPERABLE CARBON MONOXIDE DETEC- TORS IN EVERY ELEMENTARY AND SECONDARY SCHOOL BUILDING WITHIN THE STATE WHEREIN THE USE OF HEATING OR OTHER EQUIPMENT POSES A SUBSTANTIAL RISK OF EXPOSURE TO CARBON MONOXIDE. A. SUCH REGULATIONS SHALL PROVIDE THAT: (I) ANY CARBON MONOXIDE DETECTION EQUIPMENT INSTALLED SHALL BE LISTED BY A NATIONALLY RECOGNIZED TESTING LABORATORY AS MEETING OR EXCEEDING AMERICAN NATIONAL STANDARDS INSTITUTE/UNDERWRITERS LABORATORIES (ANSI/UL) STANDARD 2075 OR ANSI/UL STANDARD 2034; AND (II) CARBON MONOXIDE DETECTION EQUIPMENT SHALL BE INSTALLED IN ACCORDANCE WITH THE MANUFACTURER'S INSTRUCTIONS AND INSTAL- LATION REQUIREMENTS OF NATIONAL FIRE PROTECTION ASSOCIATION STANDARD 720, 2012 EDITION. B. FOR ANY SCHOOL BUILDING FOR WHICH A PERMIT FOR NEW OCCUPANCY OR A PERMIT FOR RENOVATION IS ISSUED ON OR AFTER JANUARY FIRST, TWO THOUSAND SEVENTEEN, SUCH REGULATIONS SHALL (I) PROHIBIT THE INSTALLATION OF ANY BATTERY-OPERATED CARBON MONOXIDE DETECTION EQUIPMENT OR ANY PLUG-IN CARBON MONOXIDE WARNING EQUIPMENT THAT HAS A BATTERY AS ITS BACK-UP POWER SOURCE; AND (II) REQUIRE THAT A SIGNAL FROM A CARBON MONOXIDE DETECTOR SHALL BE AUTOMATICALLY TRANSMITTED TO AN APPROVED SUPERVISING STATION OR CONSTANTLY ATTENDED ON-SITE LOCATION.
