BILL NUMBER:S5543 TITLE OF BILL: An act to amend the racing, pari-mutuel wagering and breeding law, in relation to establishing the commission on retired horses PURPOSE: To establish a Commission on Retired Horses to monitor the whereabouts and treatment of retired racehorses. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Amends the Racing, Pari-Mutuel Wagering and Breeding Law by adding a new article 7A which establishes the Commission on Retired Horses. Section 2: Effective date. JUSTIFICATION: Horses have played a significant role in the history and culture of the United States; more specifically, horses in the racing industry have generated billions of dollars for the state of New York. BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Racing, Gaming and Wager- ing AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to establishing the commission on retired horses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The racing, pari-mutuel wagering and breeding law is amended by adding a new article 7-A to read as follows: ARTICLE 7-A COMMISSION ON RETIRED HORSES SECTION 710. COMMISSION ON RETIRED HORSES. 711. POWERS AND DUTIES OF THE COMMISSION. 712. VIOLATIONS; PENALTIES. S 710. COMMISSION ON RETIRED HORSES. THERE IS HEREBY CREATED A COMMIS- SION ON RETIRED HORSES. SUCH COMMISSION SHALL CONSIST OF SEVEN MEMBERS, FOUR OF WHOM SHALL BE APPOINTED BY THE GAMING COMMISSION, AND ONE EACH OF WHOM SHALL BE APPOINTED BY THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY, RESPECTIVELY. S 711. POWERS AND DUTIES OF COMMISSION. 1. THE COMMISSION SHALL BE RESPONSIBLE FOR OVERSIGHT OF THE TREATMENT OF RETIRED RACE HORSES IN THIS STATE. SUCH OVERSIGHT SHALL MEAN THAT PRIOR TO THE SALE OR TRANSFER OF A RETIRED RACE HORSE, THE OWNER OF SUCH RACE HORSE SHALL FURNISH TO THE COMMISSION, ON A FORM PRESCRIBED BY THE COMMISSION, THE CONTACT INFORMATION OF THE NEW OWNER, WHICH SHALL AT LEAST INCLUDE THE NAME, ADDRESS AND PHONE NUMBER OF SUCH PERSON OR ENTITY. A RETIRED RACE HORSE MAY NOT BE TRANSPORTED ACROSS INTERNATIONAL BORDERS WITHOUT THE PRIOR AUTHORIZATION OF THE COMMISSION. IN THE EVENT THAT A TRANSFER OF A RETIRED RACE HORSE REQUIRES INTERNATIONAL TRANSPORT, THE NEW OWNER SHALL BE SUBJECT TO A BACKGROUND CHECK PRIOR TO THE COMMISSION'S AUTHORIZATION OF SUCH TRANSFER.
