BILL NUMBER:S6047 TITLE OF BILL: An act to amend the education law, in relation to grades one through six physical education instruction PURPOSE: This bill would require physical education in elementary schools to be taught by certified physical education teachers. SUMMARY OF SPECIFIC PROVISIONS: Section 1 adds a new section to the Education Law § 815 to require physical education in grades one through six to be taught by certified physical education teachers. JUSTIFICATION: National research has concluded that New York's physical education requirements and standards are among the best in the nation. The learning standards include but are not limited to physical activity, fitness and health. In addition, the physical education curriculum must include instruction about safe and healthy environments for physical activity and management of personal and community resources for physical activity. The best persons to teach physical education therefore are certified physical education teachers who are trained and qualified to meet these curriculum requirements. This bill will assure that the best persons - certified physical education teachers - teach physical education in elementary schools. MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to grades one through six physical education instruction THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 817 to read as follows: S 817. PHYSICAL EDUCATION INSTRUCTION FOR GRADES ONE THROUGH SIX. PHYSICAL EDUCATION IN GRADES ONE THROUGH SIX SHALL BE TAUGHT BY CERTI- FIED PHYSICAL EDUCATION TEACHERS. S 2. This act shall take effect on the first of July next succeeding the date on which it shall have become a law.
