AN ACT to amend the education  law,  in  relation  to  test  preparation
  programs for certain students

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 305 of the education law is amended by adding a new
subdivision 55 to read as follows:
  55. TEST PREPARATION FOR  CERTAIN  STUDENTS.  THE  COMMISSIONER  SHALL
ESTABLISH  IN  CITIES  HAVING  A  POPULATION  OF ONE MILLION OR MORE, IN
CONJUNCTION WITH THE APPROPRIATE OFFICIAL  WITH  JURISDICTION  OVER  THE
PUBLIC  SCHOOL  SYSTEM  IN  SUCH  CITIES, A TEST PREPARATION PROGRAM FOR
STUDENTS IN THE SEVENTH GRADE HAVING SCORED NO HIGHER  THAN  A  FOUR  ON
EITHER  THE  ENGLISH LANGUAGE ARTS TEST OR MATHEMATICS TEST ADMINISTERED
BY SUCH CITIES AND WHO INTEND TO APPLY  TO  TAKE  THE  SPECIALIZED  HIGH
SCHOOL  ADMISSIONS  TEST. SUCH TEST PREPARATION SHALL BE OFFERED FREE OF
CHARGE DURING THE REGULAR OPERATING HOURS OF THE SCHOOL DAY.
  S 2. This act shall take effect immediately.
