BILL NUMBER: S6986 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to state funding for electronic benefit transfer technology at farmers' markets PURPOSE : This proposal seeks to broaden access to healthy foods, and to increase the number of farmers' markets authorized to accept EBT payment by alleviating the fees and costs associated with electronic benefit transfer technology (EBT) equipment at farmers' markets. SUMMARY OF PROVISIONS : Section 1 expands the Agriculture and Markets Law at section 262, State aid for farmers' markets, by alleviating the service costs and fees associated with furnishing electronic benefit transfer equipment, including transaction fees, wireless technology fees, application fees and seasonal reactivation fees. Section 2 provides the effective date. EXISTING LAW :

RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to state funding for electronic benefit transfer technology at farmers' markets THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 1 of section 262 of the agri- culture and markets law, as added by section 4 of part U of chapter 60 of the laws of 2011, is amended to read as follows: (c) equipment costs associated with improving farmers' market func- tions, including but not limited to expanding access to electronic bene- fit transfer technology [for] AND SERVICE COSTS AND ANY FEES ASSOCIATED WITH FURNISHING SUCH TECHNOLOGY, SUCH AS TRANSACTION FEES, WIRELESS TECHNOLOGY FEES, APPLICATION FEES, AND SEASONAL REACTIVATION FEES, AT farmers' markets and other non-traditional food access points in food deserts in the state. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
