BILL NUMBER: S7488 TITLE OF BILL : An act to amend the transportation law, in relation to taxi and limousine services equipped with wheelchair accessible vehicles PURPOSE : To create an efficient model for the provision of transportation services to people with disability that requires the use of a wheelchair. SUMMARY OF PROVISIONS : Section one of this bill authorizes The Department to promulgate such rules and regulations as it shall deem necessary to implement the provisions of this title. Section two of this bill requires that The New York City Taxi and Limousine Commission shall provide a for-hire wheelchair accessible transportation and dispatch service. Section three of this bill states that the New York City Taxi and Limousine Commission (TLC) should stop its practice of penalizing for-hire bases for a rule the TLC itself admits the industry cannot comply with, and that the for-hire vehicle industry shall not be

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the transportation law, in relation to taxi and limou- sine services equipped with wheelchair accessible vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The transportation law is amended by adding a new section 152-a to read as follows: S 152-A. FOR-HIRE ACCESSIBLE WHEELCHAIR TRANSPORTATION. 1. THE DEPARTMENT IS AUTHORIZED TO PROMULGATE SUCH RULES AND REGULATIONS AS IT SHALL DEEM NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. 2. THE NEW YORK CITY TAXI AND LIMOUSINE COMMISSION SHALL PROVIDE A DISPATCH SERVICE FOR WHEELCHAIR ACCESSIBLE VEHICLES. SUCH DISPATCH SERVICE SHALL BE RESPONSIBLE FOR PROVIDING FOR-HIRE WHEELCHAIR ACCESSI- BLE TRANSPORTATION. 3. THE NEW YORK CITY FOR-HIRE BASES, AS DEFINED BY REGULATIONS OF THE NEW YORK CITY TAXI AND LIMOUSINE COMMISSION, SHALL NOT BE SUBJECT TO NEW YORK CITY TAXI AND LIMOUSINE COMMISSION REGULATIONS RELATED TO WHEEL- CHAIR ACCESSIBLE VEHICLES NOR SHALL SUCH FOR-HIRE BASES BE SUBJECT TO THE RESPONSIBILITIES PROVIDED IN THIS ARTICLE. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law, provided, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized to be made and completed on or before such date.
