BILL NUMBER: S8039 TITLE OF BILL : An act to amend the mental hygiene law, in relation to requiring annual radon testing of facilities PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to require annual radon testing of facilities issued an operating certificate to care for those with developmental disabilities. SUMMARY OF SPECIFIC PROVISIONS : Section 1 is amended by adding subdivision (g) which shall require annual radon testing of facilities issued an operating certificate. Such testing shall be performed by a trained and certified, independent entity. Where radon levels exceed 4 pCi/L, corrective action shall be taken within the 30 days. Where radon levels exceed 8 pCi/L, corrective action shall be taken within 14 days. Test results must be posted online. A comprehensive report of test results shall be available each year by January 15th. Section 2: All facilities shall have their first annual radon test within 120 days of this act.

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the mental hygiene law, in relation to requiring annual radon testing of facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 16.11 of the mental hygiene law is amended by adding a new subdivision (g) to read as follows: (G) THE COMMISSIONER SHALL REQUIRE ANNUAL RADON TESTING OF FACILITIES ISSUED AN OPERATING CERTIFICATE PURSUANT TO THIS ARTICLE. SUCH TESTING SHALL BE PERFORMED BY A TRAINED AND CERTIFIED, INDEPENDENT ENTITY. (1) WHERE RADON LEVELS EXCEED 4 PCI/L, CORRECTIVE ACTIONS SHALL BE TAKEN WITHIN THIRTY DAYS BY TRAINED AND CERTIFIED SPECIALISTS TO SUCCESSFULLY REDUCE THE RADON LEVEL BELOW 4 PCI/L. (2) WHERE RADON LEVELS EXCEED 8 PCI/L, CORRECTIVE ACTION SHALL BE TAKEN WITHIN FOURTEEN DAYS BY TRAINED AND CERTIFIED SPECIALISTS TO SUCCESSFULLY REDUCE THE RADON LEVEL BELOW 4 PCI/L. (3) EACH FACILITY MUST POST THEIR ANNUAL TEST RESULTS ONLINE. RESULTS SHALL BE POSTED PRIOR TO AND FOLLOWING ANY ACTIONS TAKEN TO REDUCE RADON ARE COMPLETED. IF NO CORRECTIVE ACTIONS ARE NECESSARY, PROOF OF SUCH SHALL BE POSTED. (4) A COMPREHENSIVE REPORT INCLUDING THE TEST RESULTS FROM ALL FACILI- TIES SHALL BE PROVIDED TO THE GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, AND THE SPEAKER OF THE ASSEMBLY NO LATER THAN THE FIFTEENTH OF JANUARY EACH YEAR AND SHALL BE POSTED ONLINE BY THE SAME DATE. S 2. Within 120 days of the effective date of this act, all facilities shall have had their first annual radon test completed. S 3. This act shall take effect immediately. BILL NUMBER: S8039A TITLE OF BILL : An act to amend the mental hygiene law, in relation to requiring annual radon testing of schools PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to require annual radon testing of facilities that care for residents with developmental disabilities. SUMMARY OF SPECIFIC PROVISIONS : Section 1: Section 16.11 of the mental hygiene law is amended by adding subdivision (g) which shall require annual radon testing in all schools as defined in section 1.03 of mental hygiene law ("School" means the in-patient service of a developmental center or other residential facility for individuals with developmental disabilities under the jurisdiction of the office for people with developmental disabilities or a facility for the residential care, treatment, training, or education of individuals with developmental disabilities which has been issued an operating certificate by the commissioner of developmental disabilities.) Such testing shall be performed by a trained and certified, independent entity. Where radon levels exceed 4 pCi/L, corrective action shall be taken within the 30 days.
