Prohibits dangerous wheels; defines dangerous wheels as any wheel, wheel cover, hubcap, lug nut or lug cap, lug nut covers, wheel stud covers, etc. that is modified from original manufacturer's standard part or aftermarket part and extends two inches or more beyond the surface of the wheel rim; imposes fines for violation.

BILL NUMBER:S2393 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to prohibiting dangerous wheels PURPOSE: This bill is intended to prohibit the use of certain types of wheels and wheel accessories that incorporate sharp projections or constitute a hazard to pedestrians and cyclists or may cause unusual or excessive damage to other vehicles in the event of contact. The prohibition extends to the use of any wheel, wheel cover, hubcap, lug nut or lug cap, prong, blade, spike or any part affixed to any of the aforementioned items that uses aftermarket parts not designed or manufactured by the Original Equipment Vehicle Manufacturer and which extends two inches or more beyond the surface of the wheel, or extends beyond the body of the vehicle. SUMMARY OF PROVISIONS: Section one amends (Section 385 of the Vehicle and Traffic Law by adding a new subdivision 13-a **OR** 375 of the Vehicle and Traffic Law by adding a new subdivision 350-b) defining dangerous wheels and prohibiting their use. Section two sets the effective date.

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to prohibiting dangerous wheels THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 375 of the vehicle and traffic law is amended by adding a new subdivision 35-b to read as follows: 35-B. USE OF DANGEROUS WHEELS PROHIBITED. (A) NO PERSON SHALL DRIVE UPON A PUBLIC HIGHWAY A MOTOR VEHICLE, TRAILER, OR SEMI-TRAILER THAT IS EQUIPPED WITH DANGEROUS WHEELS. (B) ANY PERSON CONVICTED OF A VIOLATION OF THIS SUBDIVISION SHALL FOR A FIRST CONVICTION THEREOF BE PUNISHED BY A FINE OF UP TO TWO HUNDRED FIFTY DOLLARS; FOR A CONVICTION OF A SECOND VIOLATION, BOTH OF WHICH WERE COMMITTED WITHIN A PERIOD OF EIGHTEEN MONTHS, SUCH PERSON SHALL BE GUILTY OF A TRAFFIC INFRACTION AND SHALL BE PUNISHED BY A FINE OF NOT LESS THAN TWO HUNDRED FIFTY DOLLARS AND NOT MORE THAN THREE HUNDRED FIFTY DOLLARS; UPON CONVICTION OF A THIRD OR SUBSEQUENT VIOLATION, ALL OF WHICH WERE COMMITTED WITHIN A PERIOD OF EIGHTEEN MONTHS, SUCH PERSON SHALL BE GUILTY OF A TRAFFIC INFRACTION AND SHALL BE PUNISHED BY A FINE OF NOT LESS THAN THREE HUNDRED FIFTY DOLLARS AND NOT MORE THAN SEVEN HUNDRED FIFTY DOLLARS. (C) AS USED IN THIS SUBDIVISION, "DANGEROUS WHEELS" MEANS ANY WHEEL, WHEEL COVER, HUBCAP, LUG NUT OR LUG CAP, LUG NUT COVERS, WHEEL STUD COVERS, PRONGS, BLADES, SPIKES, OR ANY OTHER PROJECTION OR ANY PART AFFIXED TO ANY OF THE AFOREMENTIONED ITEMS THAT: (I) IS MODIFIED FROM THE ORIGINAL VEHICLE MANUFACTURER'S STANDARD PART FOR THE VEHICLE ON WHICH IT IS INSTALLED, IS SUBSTITUTED WITH A NON-ORI- GINAL AFTERMARKET PART, OR TO WHICH AFTERMARKET PARTS ARE ADDED TO THE MANUFACTURER'S OTHERWISE STANDARD WHEELS OR COVERS; AND EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
