S T A T E O F N E W Y O R K ________________________________________________________________________ 10099 I N A S S E M B L Y March 14, 2018 ___________ Introduced by M. of A. O'DONNELL -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to requiring the commissioner of health to develop guidelines for the prescribing of opioid antagonists THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 3346 to read as follows: § 3346. GUIDELINES FOR THE PRESCRIBING OF OPIOID ANTAGONISTS. 1. THE COMMISSIONER SHALL ADOPT GUIDELINES FOR THE PRESCRIBING OF OPIOID ANTAG- ONISTS THAT ARE APPLICABLE TO ALL LICENSED HEALTH CARE PROVIDERS IN THE STATE WHO ARE AUTHORIZED TO PRESCRIBE AN OPIOID ANALGESIC. SUCH GUIDE- LINES MUST ADDRESS: (A) PRESCRIBING AN OPIOID ANTAGONIST TO A PATIENT TO WHOM AN OPIOID MEDICATION IS ALSO PRESCRIBED; AND (B) IDENTIFYING PATIENTS AT RISK OF AN OPIOID-RELATED DRUG OVERDOSE AND PRESCRIBING AN OPIOID ANTAGONIST TO THAT PATIENT OR TO A PERSON IN A POSITION TO ADMINISTER THE OPIOID ANTAGONIST TO THAT PATIENT. 2. IN ADOPTING GUIDELINES UNDER THIS SECTION, THE COMMISSIONER SHALL CONSULT WITH THE STATE BOARD OF PHARMACY AS WELL AS MATERIALS PUBLISHED BY, BUT NOT LIMITED TO, THE SUBSTANCE ABUSE AND MENTAL HEALTH SERVICES ADMINISTRATION OF THE UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES AND OTHER APPROPRIATE MATERIALS, INCLUDING MEDICAL JOURNALS SUBJECT TO PEER REVIEW AND PUBLICATIONS BY MEDICAL PROFESSIONAL ASSOCI- ATIONS. 3. THE COMMISSIONER IS AUTHORIZED TO PROMULGATE RULES AND REGULATIONS NECESSARY FOR THE IMPLEMENTATION OF THIS SECTION. § 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however, that effective immediate- ly, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such date.
