 AN ACT to authorize and direct the department of  health  to  conduct  a
   study on the effectiveness of portable anti-choking devices
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The department of health is hereby authorized and  directed
 to  prepare  or  have  prepared a study on the effectiveness of portable
 anti-choking devices. "Portable anti-choking device" for the purposes of
 this act shall mean a portable medical device meant for use in a choking
 emergency which uses manually created suction to remove  blockages  from
 the airway.
   §  2.  The department of health shall prepare a report to the governor
 and the legislature based on the findings  of  the  study  described  in
 section  one of this act which shall include an analysis of the findings
 of such study including the success rate of the use  of  portable  anti-
 choking  devices.  Such  report  shall  be  filed within one year of the
 effective date of this act.
   § 3. This act shall take effect immediately.
