   read once and referred to the Committee on Environmental Conservation
 
 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   prohibiting the use of residential automatic pesticide misting systems
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 33-1301 of the environmental  conservation  law  is
 amended by adding a new subdivision 12 to read as follows:
   12. FOR ANY PERSON, ON AND AFTER JANUARY FIRST, TWO THOUSAND NINETEEN,
 TO INSTALL OR UTILIZE ANY RESIDENTIAL AUTOMATIC PESTICIDE MISTING SYSTEM
 IN  THIS STATE. FOR PURPOSES OF THIS SUBDIVISION, "RESIDENTIAL AUTOMATIC
 PESTICIDE MISTING SYSTEM" MEANS  ANY  DEVICE  THAT  IS  DESIGNED  TO  BE
 INSTALLED ON, NEAR OR AROUND THE EXTERIOR OF ANY RESIDENTIAL DWELLING OR
 THE  GROUNDS OF SUCH RESIDENTIAL DWELLING AND TO AUTOMATICALLY SPRAY ANY
 PESTICIDE SOLUTION AT TIMED INTERVALS.
   § 2. This act shall take effect immediately.
