S T A T E O F N E W Y O R K ________________________________________________________________________ 11310 I N A S S E M B L Y August 15, 2018 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Pichardo) -- read once and referred to the Committee on Health AN ACT to amend the labor law and the public health law, in relation to requiring small businesses to have and maintain a first aid kit on the premises of the business at all times THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The labor law is amended by adding a new section 476 to read as follows: § 476. FIRST AID KITS IN SMALL BUSINESSES. ALL BUSINESSES WITH FIFTY OR LESS EMPLOYEES SHALL PROVIDE EQUIPMENT AND MAINTAIN ON THE PREMISES AT ALL TIMES, A COMPLETE FIRST AID KIT CONTAINING ALL THAT EQUIPMENT REASONABLY CALCULATED TO PROVIDE EMERGENCY MEDICAL AID TO INJURED PERSONS. SUCH FIRST AID KITS SHALL BE STORED IN A READILY ACCESSIBLE LOCATION AND AVAILABLE FOR USE BY ANY PERSON WHO ENTERS THE PREMISES OF THE BUSINESS. § 2. Subdivision 1 of section 201 of the public health law is amended by adding a new paragraph (w) to read as follows: (W) SUPERVISE AND REGULATE COMPLIANCE WITH FIRST AID KIT REQUIREMENTS PURSUANT TO SECTION FOUR HUNDRED SEVENTY-SIX OF THE LABOR LAW. SUCH COMPLIANCE SHALL BE VISUALLY CONFIRMED AND OBSERVED IN CONJUNCTION WITH ANY OTHER HEALTH OR SAFETY INSPECTION PERFORMED BY THE DEPARTMENT OR BY CODE ENFORCEMENT PERSONNEL, AS DEFINED IN SECTION THREE HUNDRED SEVEN- TY-SIX-A OF THE EXECUTIVE LAW; PROVIDED, HOWEVER, THAT IF COMPLIANCE IS CONFIRMED BY CODE ENFORCEMENT PERSONNEL, SUCH PERSONNEL SHALL NOTIFY THE DEPARTMENT OF COMPLIANCE WITH SECTION FOUR HUNDRED SEVENTY-SIX OF THE LABOR LAW. § 3.
