 AN ACT in relation to  authorizing  and  directing  the  public  service
   commission to study the impact on consumers and perform a cost benefit
   analysis of the Reforming the Energy Vision (REV) initiative

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding any other  provision  of  law,  the  public
 service  commission  is  authorized  and directed to study the impact on
 consumers and perform a cost benefit analysis of the Reforming the Ener-
 gy Vision (REV) initiative. Such study and analysis shall  include,  but
 not be limited to:
   1.  an  analysis of the potential benefits and costs of the REV initi-
 ative;
   2. the impact of REV on electric rates charged  to  consumers  through
 additional taxes and fees, increased rates or any other charges required
 to fund the REV initiative;
   3.  the  feasibility  of other potential initiatives and approaches to
 upgrading and updating the current energy infrastructure of this state;
   4. an analysis of potential benefits and costs of  such  other  initi-
 atives  determined  to be feasible pursuant to subdivision three of this
 section;
   5. the impact on consumers resulting from  the  cost  and  expense  of
 replacing existing energy infrastructure; and
   6.  any  other  information the public service commission deems neces-
 sary.
   § 2. The public service commission shall report its findings regarding
 the study and analysis authorized and directed to be performed  pursuant
 to  section  one of this act to the governor, the temporary president of
 the senate, the speaker of the assembly,  the  minority  leader  of  the

 AN  ACT  to amend the public service law and the public authorities law,
   in relation to oversight by the  New  York  state  public  authorities
   control board

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public service law is amended by adding a  new  section
 5-a to read as follows:
   §  5-A.  OVERSIGHT  BY  THE  NEW YORK STATE PUBLIC AUTHORITIES CONTROL
 BOARD.  1. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO  THE  CONTRARY,
 THE  COMMISSION SHALL APPLY TO, AND OBTAIN THE APPROVAL OF, THE NEW YORK
 STATE PUBLIC AUTHORITIES CONTROL BOARD CREATED PURSUANT TO ARTICLE ONE-A
 OF THE PUBLIC AUTHORITIES LAW PRIOR  TO  TAKING  ANY  OF  THE  FOLLOWING
 ACTIONS:
   (A)  AN  INCREASE  IN  RATES,  CHARGES, SURCHARGES, ASSESSMENTS, FEES,
 LEVIES, OR ANY OTHER COLLECTIONS, WHICH WOULD INCREASE REVENUES OBTAINED
 FROM RATEPAYERS BY MORE THAN SEVEN HUNDRED THOUSAND  DOLLARS  AND  WHICH
 REVENUES  ARE  COLLECTED  SOLELY  FOR AND DIRECTED TO THE NEW YORK STATE
 ENERGY RESEARCH AND  DEVELOPMENT  AUTHORITY  AND  WOULD  BE  EFFECTUATED
 THROUGH  A SINGLE ORDER, DECISION, OR ADMINISTRATIVE ACTION OR THROUGH A
 SERIES OF SUCH ACTIVITIES; OR
   (B) A TRANSFER, REPURPOSING, REPROGRAMMING, OR ANY OTHER  ACTION  THAT
 WOULD  CHANGE  THE  USE  OF  MONEY DIRECTED TO THE NEW YORK STATE ENERGY
 RESEARCH AND DEVELOPMENT AUTHORITY PREVIOUSLY DESIGNATED OR INTENDED FOR
 A DIFFERENT PURPOSE.
   2. EACH SUCH APPLICATION BY THE  COMMISSION  TO  THE  NEW  YORK  STATE
 PUBLIC AUTHORITIES CONTROL BOARD SHALL CONTAIN A DESCRIPTION OF ANY SUCH
 ACTION  SET  FORTH IN SUBDIVISION ONE OF THIS SECTION AND AN EXPLANATION
 OF WHY THE ACTION IS JUST AND REASONABLE AND IN THE PUBLIC INTEREST.

 AN  ACT  to  amend  the public service law, in relation to directing the
   public service commission to conduct a  study  of  the  Reforming  the
   Energy Vision initiative
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The public service law is amended by adding a  new  section
 66-o to read as follows:
   §  66-O.  REFORMING  THE  ENERGY VISION STUDY. 1. THE COMMISSION SHALL
 ANNUALLY CONDUCT A STUDY TO ANALYZE THE ECONOMIC AND ENVIRONMENTAL BENE-
 FITS AND THE ECONOMIC COSTS AND ENVIRONMENTAL BURDEN, OF  THE  REFORMING
 THE  ENERGY  VISION  INITIATIVE  (REV),  THE  PROGRESS  OF ACHIEVING REV
 RELATED GOALS, AND A DESCRIPTION OF ALL CURRENT REGULATORY, TARIFF,  AND
 MARKET DESIGNS AND INCENTIVE STRUCTURES THAT ARE INTENDED TO ACHIEVE REV
 RELATED GOALS. SUCH STUDY AND ANALYSIS SHALL INCLUDE, BUT NOT BE LIMITED
 TO:
   (A) AN ANALYSIS OF THE INITIATIVES COSTS AND BENEFITS FOR THE PURPOSES
 OF  THIS  STUDY,  THE COMMISSION SHALL CONSIDER THE IMPACTS OF REFORMING
 THE ENERGY VISION ON ELECTRIC RATES CHARGED TO CONSUMERS  THROUGH  ADDI-
 TIONAL  FEES,  INCREASED  RATES OR ANY OTHER CHARGES REQUIRED TO SUPPORT
 THE INITIATIVE.
   (B) A QUANTIFICATION OF THE APPROXIMATE  AVOIDED  LEVEL  OF  EMISSIONS
 INCLUDING, BUT NOT LIMITED TO, INFORMATION CONCERNING: NITROGEN DIOXIDE,
 SULFUR  DIOXIDE  AND  CARBON  DIOXIDE,  AS  WELL AS OTHER AIR POLLUTANTS
 DEEMED NECESSARY AND APPROPRIATE FOR STUDY BY THE  COMMISSION,  PROVIDED
 THE  COMMISSION  SHALL  USE  ITS BEST EFFORTS TO DETERMINE ENVIRONMENTAL
 LEAKAGE WHICH OCCURS WHEN THERE IS AN INCREASE IN AIR EMISSIONS  OUTSIDE
