ROSENTHAL -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to providing femi- nine hygiene products at no cost to adults and children in homeless shelters THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The social services law is amended by adding a new section 461-u to read as follows: § 461-U. FEMININE HYGIENE PRODUCTS. ANY SHELTER FOR ADULTS, AS DEFINED IN SECTION TWO OF THIS CHAPTER, WHICH IS CERTIFIED TO PROVIDE, PURSUANT TO THIS ARTICLE, TEMPORARY RESIDENTIAL SERVICES TO ADULTS OR ANY FACILI- TY WHICH IS OPERATED BY A MUNICIPALITY FOR THE PURPOSE OF PROVIDING SHELTER AND SERVICES TO HOMELESS SINGLE ADULTS, EXCLUDING THOSE LOCATED IN A CITY WITH A POPULATION OF ONE MILLION OR MORE, SHALL PROVIDE FEMI- NINE HYGIENE PRODUCTS, INCLUDING, BUT NOT LIMITED TO, SANITARY NAPKINS, TAMPONS AND PANTY LINERS, AT NO COST TO MENSTRUATING INDIVIDUALS. § 2. Subdivision 1 of section 462 of the social services law is amended by adding a new paragraph (g) to read as follows: (G) SUCH REGULATIONS SHALL PROVIDE THAT ALL FACILITIES EXERCISING CARE OR CUSTODY OF CHILDREN OR PROVIDING CARE OR SHELTER TO UNMARRIED MOTH- ERS, EXCLUDING THOSE LOCATED IN A CITY WITH A POPULATION OF ONE MILLION OR MORE, SHALL PROVIDE FEMININE HYGIENE PRODUCTS INCLUDING, BUT NOT LIMITED TO, SANITARY NAPKINS, TAMPONS AND PANTY LINERS, AT NO COST TO MENSTRUATING INDIVIDUALS. § 3. The social services law is amended by adding a new section 152-c to read as follows: § 152-C. FEMININE HYGIENE PRODUCTS. EXCEPT IN A SOCIAL SERVICES DISTRICT WITH A POPULATION OF FIVE MILLION OR MORE, ANY PROVIDER OF TEMPORARY HOUSING ASSISTANCE, WHICH SHALL INCLUDE BUT NOT BE LIMITED TO, A FAMILY SHELTER, A SHELTER FOR ADULTS, A HOTEL, AN EMERGENCY APARTMENT, A DOMESTIC VIOLENCE SHELTER, A RUNAWAY AND HOMELESS YOUTH SHELTER, OR A SAFE HOUSE FOR REFUGEES, SHALL BE REQUIRED TO PROVIDE FEMININE HYGIENE PRODUCTS, INCLUDING, BUT NOT LIMITED TO, SANITARY NAPKINS, TAMPONS AND PANTY LINERS, AT NO COST TO MENSTRUATING INDIVIDUALS. § 2.
