 AN ACT to amend the insurance law, in relation to prohibiting  insurance
   companies  from  questioning  property  owners about units occupied by
   tenants under  section  eight  housing  or  other  subsidized  housing
   programs

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The insurance law is amended by adding a new section 3429-b
 to read as follows:
   § 3429-B. QUESTIONS FOR PROPERTY OWNERS. (A) NO INSURER SHALL  REQUIRE
 ANY  PROPERTY  OWNER TO ANSWER QUESTIONS, EITHER WRITTEN OR VERBALLY, IN
 REGARDS TO WHETHER UNITS ARE OCCUPIED BY TENANTS  THAT  RECEIVE  SECTION
 EIGHT  HOUSING  STATUS,  PURSUANT  TO SECTION EIGHT OF THE UNITED STATES
 HOUSING ACT OF NINETEEN HUNDRED THIRTY-SEVEN, OR  ANY  OTHER  SUBSIDIZED
 HOUSING PROGRAMS.
   (B)  NO INSURER SHALL REFUSE TO ISSUE OR RENEW OR SHALL CANCEL A PROP-
 ERTY OWNER'S INSURANCE POLICY IF THE PROPERTY OWNER DECLINES  TO  ANSWER
 ANY QUESTION DESCRIBED UNDER SUBSECTION (A) OF THIS SECTION.
   § 2. This act shall take effect immediately.
