SIMOTAS, MOYA, OTIS -- Multi-Sponsored by -- M. of A. BRAUNSTEIN -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to intimidating a victim or witness THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 215.15 of the penal law is amended by adding a new subdivision 3 to read as follows: 3. WITH THE INTENT TO HARASS, ANNOY, THREATEN, ALARM OR INTIMIDATE SUCH PERSON, OR CAUSE LEGAL HARM OR CONSEQUENCES TO SUCH PERSON, AND OUTSIDE OF HIS OR HER OFFICIAL DUTIES, HE OR SHE REPORTS TO ANY FEDERAL, STATE OR MUNICIPAL AGENCY OR DEPARTMENT: (A) THE CITIZENSHIP OR IMMIGRATION STATUS OF A PERSON WHO: (I) HAS BEEN THE VICTIM OF A CRIMINAL ACT DESCRIBED IN THIS PART; OR (II) WHO IS SEEKING AN ORDER OF PROTECTION; OR (B) THE CITIZENSHIP OR IMMIGRATION STATUS OF A PERSON WHO IS A FAMILY MEMBER OF A PERSON WHO HAS BEEN THE VICTIM OF A CRIMINAL ACT DESCRIBED IN THIS PART, OR IS SEEKING AN ORDER OF PROTECTION. § 2.
