BILL NUMBER: S1709 TITLE OF BILL : An act to amend the insurance law, in relation to three-dimensional mammograms PURPOSE OR GENERAL IDEA OF THE BILL : This bill ensures that the procedure known as 3D Mammograms, more precisely called "tomosynthesis imaging", is covered by insurance. SUMMARY OF SPECIFIC PROVISIONS : Sections 1-4 amend the insurance law to include tomosynthesis imaging in procedures covered under insurance. Section 5 sets the effective date. JUSTIFICATION : The process known as breast tomosynthesis, perhaps more commonly known as "3D Mammograms", is a screening technique that's known to be more accurate in detecting breast cancer than current standard equipment. Specifically, the process requires less patient tests and yields higher detection rates in those fewer tests.

MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Insurance AN ACT to amend the insurance law, in relation to three-dimensional mammograms THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 3 of subsection (t) of section 1121 of the insur- ance law, as added by chapter 639 of the laws of 1996, is amended to read as follows: (3) Mammography screening INCLUDING TOMOSYNTHESIS IMAGING. § 2. Subparagraphs (C) and (F) of paragraph 11 of subsection (i) of section 3216 of the insurance law, subparagraph (C) as amended by chap- ter 219 of the laws of 2011 and subparagraph (F) as added by chapter 74 of the laws of 2016, are amended to read as follows: (C) For purposes of subparagraphs (A) and (B) of this paragraph, mammography screening means an X-ray examination of the breast using dedicated equipment, including X-ray tube, filter, compression device, screens, films and cassettes, with an average glandular radiation dose less than 0.5 rem per view per breast, OR TOMOSYNTHESIS IMAGING. (F) Screening and diagnostic imaging for the detection of breast cancer, including diagnostic mammograms, breast ultrasounds, [or] magnetic resonance imaging, OR TOMOSYNTHESIS IMAGING covered under the policy shall not be subject to annual deductibles or coinsurance. § 3. Subparagraphs (C) and (F) of paragraph 11 of subsection (l) of section 3221 of the insurance law, subparagraph (C) as amended by chap- ter 219 of the laws of 2011 and subparagraph (F) as added by chapter 74 of the laws of 2016, are amended to read as follows: (C) For purposes of subparagraphs (A) and (B) of this paragraph, mammography screening means an X-ray examination of the breast using dedicated equipment, including X-ray tube, filter, compression device, EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
