   read twice and ordered printed, and when printed to  be  committed  to
   the Committee on Mental Health and Developmental Disabilities
 
 AN  ACT to amend the mental hygiene law, in relation to notice of trans-
   fer of sex offender to community program or residence

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  13.09  of  the  mental hygiene law is amended by
 adding a new subdivision (i) to read as follows:
   (I) THE COMMISSIONER SHALL NOTIFY THE CHIEF EXECUTIVE OFFICER  OF  ANY
 MUNICIPALITY  WHERE  A  SEX OFFENDER, AS DEFINED PURSUANT TO SUBDIVISION
 ONE OF SECTION ONE HUNDRED  SIXTY-EIGHT-A  OF  THE  CORRECTION  LAW,  IS
 TRANSFERRED  TO A COMMUNITY PROGRAM OR RESIDENCE WITHIN HIS OR HER MUNI-
 CIPALITY. THE COMMISSIONER  SHALL  ALSO  NOTIFY  THE  SUPERINTENDENT  OF
 SCHOOLS  IN  WHICH  SUCH  FACILITY  IS LOCATED. NOTICE SHALL BE GIVEN NO
 LATER THAN TEN CALENDAR DAYS PRIOR TO SUCH TRANSFER.
   § 2. This act shall take effect immediately.
