                                 BILL NUMBER:  S2393

 TITLE OF BILL :  An act to amend the vehicle and traffic law, in
relation to the issuance of distinctive plates for members of Kiwanis
International

 PURPOSE :

Amends the Vehicle and Traffic Law to allow for distinctive plates for
Kiwanis members.

 SUMMARY OF PROVISIONS :

Section 1 will amend the Vehicle and Traffic Law will by adding
section § 404-y, which reads:

Subdivision 1, any member of Kiwanis International residing within New
York State, upon request, shall be issued a license plate bearing the
words "Kiwanis International".

Subdivision 2, proof must be shown to the satisfaction of the
commissioner that the applicant is a member of Kiwanis International.

Subdivision 3, provides for a fee.

Section 2 states that a distinctive plate can only be designed,

produced and issued upon the delivery to the department of a surety
bond in the amount of six thousand dollars. However if the
Commissioner receives prior to the plate design at least two hundred
orders with the annual service charge, no such surety bond will be
required.

Subdivision 2, deems that if upon the expiration of two years
following the date upon which distinctive plates in the series are
first available for sale two hundred or more sets of such plates are
sold, a bond would be discontinued.

If fewer than two hundred sets are sold, the department would be
entitled to recover against the bond in an amount proportionate to
such shortfall.

Section 3 sets forth the effective date.

 JUSTIFICATION :

Kiwanis International, a worldwide service organization, celebrated
its 100th anniversary year in 2015. Kiwanis members in over 300 local
clubs perform service projects ranging from fund raising to hands on
work in every area of New York State. Additionally, Kiwanis clubs
sponsor K-Kids Clubs in elementary schools, Builders Clubs in Middle
Schools, Key Clubs, in High Schools, Circle K Clubs at Colleges and
Universities and Aktion Clubs for adults living with disabilities, all
providing service and leadership development opportunities to members
of those communities.

These distinctive license plates would give Kiwanis members the
opportunity to receive recognition for the good work they do, as well
as promote the organization to other members of the community in which
they live.

 AN ACT to amend the vehicle and traffic law, in relation to the issuance
   of distinctive plates for members of Kiwanis International

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The vehicle and traffic law is  amended  by  adding  a  new
 section 404-y to read as follows:
   §  404-Y. DISTINCTIVE PLATES FOR MEMBERS OF THE KIWANIS INTERNATIONAL.
 1. ANY MEMBER OF KIWANIS INTERNATIONAL RESIDING  IN  THIS  STATE  SHALL,
 UPON  REQUEST,  BE  ISSUED  A  LICENSE  PLATE BEARING THE WORDS "KIWANIS
 INTERNATIONAL". APPLICATION FOR SUCH LICENSE PLATE SHALL BE  FILED  WITH
 THE  COMMISSIONER  IN  SUCH  FORM  AND  DETAIL AS THE COMMISSIONER SHALL
 PRESCRIBE.
   2. THE DISTINCTIVE PLATE AUTHORIZED PURSUANT TO THIS SECTION SHALL  BE
 ISSUED  UPON PROOF, SATISFACTORY TO THE COMMISSIONER, THAT THE APPLICANT
 IS A MEMBER OF KIWANIS INTERNATIONAL.
   3. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED
 IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT  OF  THE  REGULAR
 REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE,
 PROVIDED,  HOWEVER,  THAT AN ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-
 FIVE DOLLARS SHALL BE CHARGED FOR SUCH PLATE.
   § 2. 1. A distinctive plate established pursuant to section  404-y  of
 the  vehicle and traffic law, as added by section one of this act, shall
 only be designed, produced and issued upon the delivery to  the  depart-
 ment  of  motor  vehicles of a surety bond in the amount of six thousand
 dollars, which shall be executed by a surety company authorized  by  the
 department  of  financial  services  to transact business in this state.
 Provided, however, that if the commissioner of motor vehicles shall have
 received prior to the plate design, production and issuance of at  least

 two  hundred  orders  for such distinctive plate together with the addi-
 tional annual service charge applicable to each such order, which  shall
 be  non-refundable,  no  such  surety  bond  shall be required. All such
 service charges shall be deposited pursuant to the provisions of section
 404-oo of the vehicle and traffic law to the credit of the department of
 motor vehicles distinctive plate development fund established by section
 95-g  of  the  state  finance  law  and  shall  be  used for the design,
 production, advertising and distribution of distinctive  license  plates
 in accordance with such section 95-g.
   2.  If, upon the expiration of two years following the date upon which
 distinctive plates in the  series  are  first  available  for  sale  two
 hundred  or more sets of such plates are sold, a bond delivered pursuant
 to this section shall be discontinued. If fewer than two hundred sets of
 such plates are sold by such time,  the  department  of  motor  vehicles
 shall  be  entitled  to recover against the bond in an amount of propor-
 tionate to such shortfall.
   § 3. This act shall take effect on the one hundred eightieth day after
 it shall become a law; provided, however, that section two of  this  act
 shall  take  effect immediately; provided, further, however, that effec-
 tive immediately, the addition, amendment and/or repeal of any  rule  or
 regulation necessary for the implementation of this act on its effective
 date  are  authorized and directed to be made and completed on or before
 such effective date.
