BILL NUMBER: S2912 TITLE OF BILL : An act to amend the environmental conservation law, in relation to the siting and licensing of radioactive or hazardous waste disposal or transfer stations PURPOSE : To prohibit radioactive hazardous waste disposal or transfer stations from being sited within 1500 feet of school property. SUMMARY OF PROVISIONS : The environmental conservation law is amended by adding a new section 27-0111. JUSTIFICATION : In the past, New York state has been very irresponsible, allowing radioactive waste facilities to be sited next to or too close to places of concern, such as a public elementary school. If some sort of disaster would occur at this hazardous waste facility, something as serious as a fire, because of its proximity to the school, the results could be devastating. Especially, if the nearest fire house was recently closed due to budget cuts. Therefore, it is with responsibility that I introduce this legislation to not allow the

DILAN -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to the siting and licensing of radioactive or hazardous waste disposal or transfer stations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 27-0111 to read as follows: § 27-0111. SITING AND LICENSING OF RADIOACTIVE OR HAZARDOUS WASTE DISPOSAL OR TRANSFER STATIONS. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, A RADIOAC- TIVE WASTE DISPOSAL STATION, A RADIOACTIVE WASTE TRANSFER STATION, A HAZARDOUS WASTE DISPOSAL STATION, OR A HAZARDOUS WASTE TRANSFER STATION SHALL NOT BE SITED WITHIN ONE THOUSAND FIVE HUNDRED FEET OF THE BOUNDARY OF ANY SCHOOL PROPERTY. FURTHERMORE, NO LICENSE SHALL BE ISSUED TO ANY INDIVIDUAL TO OPERATE ANY RADIOACTIVE WASTE DISPOSAL STATION, RADIOAC- TIVE WASTE TRANSFER STATION, HAZARDOUS WASTE DISPOSAL STATION, OR HAZARDOUS WASTE TRANSFER STATION WITHIN ONE THOUSAND FIVE HUNDRED FEET OF THE BOUNDARIES OF A SCHOOL PROPERTY. § 2.
