BILL NUMBER: S2976 TITLE OF BILL : An act to amend the election law, in relation to military ballots and elections for school boards of education and school budgets PURPOSE OR GENERAL IDEA OF BILL : This legislation would make the law relating to military ballots applicable to school elections. SUMMARY OF SPECIFIC PROVISIONS : Paragraph (a) of subdivision 1 of Section 10108 of the Election Law, as amended by Chapter 4 of the Laws of 2011, is amended to provide that ballots for military voters shall be mailed or otherwise distributed by the Board of Elections for any common, union free, central or central high school district election for which absentee ballots are required to be provided pursuant to Sections 2018-a, 2018-b, or 2613 of the Education Law. JUSTIFICATION : Under existing law, persons serving in the military, including spouses and dependents may register as military voters in New York State. HEVESI, HOOPER -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to military ballots and elections for school boards of education and school budgets THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 10-108 of the election law, as amended by chapter 4 of the laws of 2011, is amended to read as follows: (a) Ballots for military voters shall be mailed or otherwise distrib- uted by the board of elections, in accordance with the preferred method of transmission designated by the voter pursuant to section 10-107 of this article, as soon as practicable but in any event not later than thirty-two days before a primary or general election; twenty-five days before a New York city community school board district or city of Buffalo school district election OR ANY COMMON, UNION FREE, CENTRAL OR CENTRAL HIGH SCHOOL DISTRICT ELECTION FOR WHICH ABSENTEE BALLOTS ARE REQUIRED TO BE PROVIDED PURSUANT TO SECTIONS TWO THOUSAND EIGHTEEN-A, TWO THOUSAND EIGHTEEN-B, OR TWENTY-SIX HUNDRED THIRTEEN OF THE EDUCATION LAW; fourteen days before a village election conducted by the board of elections; and forty-five days before a special election. A voter who submits a military ballot application shall be entitled to a military ballot thereafter for each subsequent election through and including the next two regularly scheduled general elections held in even numbered years, including any run-offs which may occur; provided, however, such application shall not be valid for any election held within seven days EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

BILL NUMBER: S2976A SPONSOR: LAVALLE TITLE OF BILL: An act to amend the education law, in relation to military voters and ballots for election of members of the board of education and school district public library trustees, and the adoption of the annual budget and school district public library budget and referenda PURPOSE: This legislation would provide military voters the opportunity to vote in school district elections. SUMMARY OF PROVISIONS: Section 1 of the bill adds a new section 2018-d to the education law to provide military voters the opportunity to cast their ballots for election of members of the board of education and school district, public library trustees and the adoption of the annual budget and school district public library budget and referenda.

The education law is amended by adding a new section 2018-d to read as follows: § 2018-D. MILITARY VOTERS. 1. AS USED IN THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "MILITARY SERVICE" MEANS THE MILITARY SERVICE OF THE STATE, OR OF THE UNITED STATES, INCLUDING THE ARMY, NAVY, MARINE CORPS, AIR FORCE, COAST GUARD, MERCHANT MARINE AND ALL COMPONENTS THEREOF, AND THE COAST AND GEODETIC SURVEY, THE PUBLIC HEALTH SERVICE, THE NATIONAL GUARD WHEN IN THE SERVICE OF THE UNITED STATES PURSUANT TO CALL AS PROVIDED BY LAW, AND THE CADETS OR MIDSHIPMEN OF THE UNITED STATES MILITARY ACADEMY, UNITED STATES NAVAL ACADEMY, UNITED STATES AIR FORCE ACADEMY AND UNITED STATES COAST GUARD ACADEMY. (B) "MILITARY VOTER" MEANS A QUALIFIED VOTER OF THE STATE OF NEW YORK WHO IS IN ACTUAL MILITARY SERVICE, AS DEFINED IN PARAGRAPH (A) OF THIS SUBDIVISION, AND BY REASON OF SUCH MILITARY SERVICE IS ABSENT FROM HIS OR HER DISTRICT ON THE DAY OF REGISTRATION OR ELECTION, OR A VOTER WHO IS DISCHARGED FROM SUCH MILITARY SERVICE WITHIN THIRTY DAYS OF AN ELECTION AND THE SPOUSE, PARENT, CHILD OR DEPENDENT OF SUCH VOTER ACCOM- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
