BILL NUMBER: S3038 TITLE OF BILL : An act to amend the real property tax law, in relation to requiring STAR program payments to be issued timely PURPOSE : This bill would ensure that those who pay property taxes in New York State are reimbursed their STAR credit in a timely manner by creating a system of penalties for every credit that is mailed out late. SUMMARY OF PROVISIONS : Section one of the bill adds a new subdivision to section 425 of the real property tax law, as it relates to providing taxpayers who have applied for a STAR exemption with a reimbursement on or before September 30; adds a 5% credit for any check mailed after September 30, with an additional 1% per month thereafter, of the total exemption payment; adds a 5% credit for any check mailed in the incorrect amount after September 30, with an additional 1% per month thereafter, of the total exemption payment; mandates credit reimbursement within a 90-day window for any homeowner who applied to STAR after July 1; authorizes a 5% credit of the total credit amount to late applicants in the first month after the 90-day period, and an additional 1% credit in the months thereafter.

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the real property tax law, in relation to requiring STAR program payments to be issued timely THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 425 of the real property tax law is amended by adding a new subdivision 17 to read as follows: 17. PAYMENT OF STAR EXEMPTION. (A) EACH PROPERTY OWNER WHO COMPLETES THE APPLICATION AND REGISTRATION PROCESS BEFORE JULY FIRST OF A GIVEN YEAR SHALL HAVE ANY EXEMPTION PAYMENTS OWED ISSUED BY THE COMMISSIONER ON OR BEFORE SEPTEMBER THIRTIETH OF THAT SAME YEAR. IN THE EVENT THAT THE EXEMPTION PAYMENT IS ISSUED AFTER THE REQUIRED DATE OR IS ISSUED IN THE INCORRECT AMOUNT, THE COMMISSIONER SHALL INCLUDE A LATE FEE OF FIVE PERCENT, WITH AN ADDITIONAL ONE PERCENT PER MONTH THEREAFTER, OF THE TOTAL EXEMPTION PAYMENT. Such payment shall be [issued by September thirtieth] POSTMARKED NO LATER THAN FIFTEEN DAYS PRIOR TO THE EXPIRATION OF THE INTEREST FREE PERIOD TO PAY SCHOOL TAXES of the year the credit is allowed, or [as soon thereafter as is practicable] NO LATER THAN NINETY DAYS AFTER THE RECEIPT OF AN APPLICATION FOR THE CREDIT, WHICHEVER IS LATER.
