   PERKINS -- read twice and ordered printed,  and  when  printed  to  be
   committed to the Committee on Environmental Conservation
 
 AN  ACT  to  amend  the  environmental  conservation law, in relation to
   prohibiting the use of glyphosate and products  containing  glyphosate
   in certain parks, playgrounds and picnic areas
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The environmental conservation law is amended by  adding  a
 new section 37-0115 to read as follows:
 § 37-0115. PROHIBITION  OF GLYPHOSATE AND PRODUCTS CONTAINING GLYPHOSATE
              IN PARKS, PLAYGROUNDS AND PICNIC AREAS.
   1. NO PERSON, FIRM, PARTNERSHIP, ASSOCIATION, LIMITED LIABILITY COMPA-
 NY, CORPORATION, MUNICIPALITY OR GOVERNMENT ENTITY SHALL USE  GLYPHOSATE
 OR  ANY PRODUCTS CONTAINING GLYPHOSATE IN ANY PARK, PLAYGROUND OR PICNIC
 AREA OWNED OR OPERATED BY NEW YORK STATE, NEW YORK CITY, OR ANY  MUNICI-
 PALITY THEREOF.
   2. FOR THE PURPOSES OF THIS SECTION:
   (A)  GLYPHOSATE  MEANS  A  SYNTHETIC  COMPOUND THAT IS A NON-SELECTIVE
 SYSTEMIC HERBICIDE, ALSO KNOWN AS N-(PHOSPHONOMETHYL) GLYCERINE  WITH  A
 CHEMICAL FORMULA OF C3H8NO5P.
   (B) "MUNICIPALITY" MEANS A CITY, COUNTY, TOWN, VILLAGE, PUBLIC BENEFIT
 CORPORATION  OR  SCHOOL  DISTRICT  OR  AND IMPROVEMENT DISTRICT WITHIN A
 CITY, COUNTY, TOWN OR VILLAGE, OR ANY COMBINATION THEREOF.
   3. THE DEPARTMENT IS AUTHORIZED TO PROMULGATE  SUCH  RULES  AND  REGU-
 LATIONS  AS  IT SHALL DEEM NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS
 SECTION.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law; provided, however, that effective immediate-
 ly, the addition, amendment and/or repeal  of  any  rule  or  regulation
 necessary  for  the implementation of this act on its effective date are
 authorized and directed to be made  and  completed  on  or  before  such
 effective date.
