BILL NUMBER: S3570 TITLE OF BILL : An act to amend the public health law, in relation to cardiovascular technologists PURPOSE : Authorize Cardiovascular Technologists (CVTs) to administer contrast materials during cardiovascular interventional procedures, under the direct supervision of a physician. SUMMARY OF PROVISIONS : Section 1 defines a cardiovascular technologist Section 2 authorizes the cardiovascular technologist to administer the contrast materials during cardiovascular interventional procedures under the direct supervision of a physician. Section 3 provides that the bill would take effect immediately EXISTING LAW : Under current law, the contract materials must be administered by physicians.

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to cardiovascular technologists THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3501 of the public health law is amended by adding a new subdivision 20 to read as follows: 20. "CARDIOVASCULAR TECHNOLOGIST" MEANS A PERSON WHO IS AUTHORIZED TO ASSIST WITH DIAGNOSTIC EXAMINATIONS AND THERAPEUTIC INTERVENTIONS OF THE HEART AND BLOOD VESSELS UNDER THE DIRECT SUPERVISION OF A PHYSICIAN, INCLUDING INVASIVE CARDIOLOGY-CARDIAC CATHETERIZATION, NON-INVASIVE CARDIOLOGY, NON-INVASIVE PERIPHERAL VASCULAR STUDY, AND CARDIAC ELECTRO- PHYSIOLOGY. § 2. The opening paragraph of subdivision 4 of section 3502 of the public health law is designated paragraph (a) and a new paragraph (b) is added to read as follows: (B) NOTHING IN THIS ARTICLE OR IN ANY OTHER PROVISION OF LAW SHALL PREVENT A CARDIOVASCULAR TECHNOLOGIST, ACTING UNDER THE DIRECT SUPER- VISION OF A PHYSICIAN, FROM INTRODUCING CONTRAST MEDIUM TO A PATIENT DURING A CARDIOVASCULAR DIAGNOSTIC OR INTERVENTIONAL PROCEDURE THROUGH AN ARTERIAL LINE PLACED BY A LICENSED PRACTITIONER. THE INTRODUCTION OF CONTRAST MEDIUM IN PREPARATION OF OR DURING SUCH PROCEDURES SHALL NOT CONSTITUTE THE ADMINISTRATION OF MEDICATION FOR THE PURPOSES OF THIS SECTION. § 3. Subdivision 4 of section 3502 of the public health law, as amended by chapter 175 of the laws of 2006, is amended to read as follows: 4. (A) No radiologic technologist shall administer or inject intrave- nous contrast media unless [(a)] (I) the individual is certified by the department to perform such function in accordance with the commission- er's rules and regulations [(b)] (II) such administration or injection has been approved by a physician, physician's assistant, nurse practi- tioner or registered professional nurse within twenty-four hours prior to the administration or injection [(c)] (III) a physician, physician's assistant, nurse practitioner or registered professional nurse performs an evaluation of the patient on the day of the procedure. Administration or injection of contrast media means and is limited to the placement or insertion of a needle or a catheter, not exceeding three inches in length and not above the level of the axilla into a person's upper extremity and the administration or injection of the intravenous contrast media, manually or by mechanical injector, but does not mean the determination of the type or volume of media to be administered or injected.
