BILL NUMBER: S3616 TITLE OF BILL : CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to article 1 of the constitution, in relation to protection of the right to personal privacy PURPOSE OR GENERAL IDEA OF BILL : To establish a constitutional right to privacy SUMMARY OF SPECIFIC PROVISIONS : Amends article 1 of the New York State Constitution. JUSTIFICATION : Currently there is no provision in the state Constitution expressly guaranteeing a right to privacy. This provision incorporates a privacy right in the constitution. PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment to article 1 of the constitution, in relation to protection of the right to personal privacy Section 1. Resolved (if the Assembly concur), That article 1 of the constitution be amended by adding a new section 19 to read as follows: § 19. THE INHERENT RIGHT OF EACH PERSON TO PERSONAL PRIVACY SHALL NOT BE INFRINGED. EACH NATURAL PERSON SHALL BE GUARANTEED BY THIS CONSTITU- TION AND SUCH LEGISLATION AS MAY BE NECESSARY. § 2. Resolved (if the Assembly concur), That the foregoing amendment be referred to the first regular legislative session convening after the next succeeding general election of members of the assembly, and, in conformity with section 1 of article 19 of the constitution, be published for 3 months previous to the time of such election.
