BILL NUMBER: S377 TITLE OF BILL : An act to amend the public health law, in relation to the safe disposal of unused controlled substances PURPOSE : To provide for the designation of pharmacies as disposal sites for controlled substances to further aid in the fight against drug abuse. SUMMARY OF PROVISIONS : Section 1. Adds a new subdivision 4 of section 3343-b of the public health law, as amended by chapter 379 of the laws of 2015 to authorize the commissioner to promulgate rules and regulations necessary to require chain pharmacies to operate drug disposal sites based on the geographical location and number of locations in each county of the state. JUSTIFICATION : Currently, the Heroin and Opioid epidemic is scourging our communities and destroying lives across the United States. New York State has been a leader in enacting meaningful reforms and initiatives to combat this horrible epidemic.

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the safe disposal of unused controlled substances THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3343-b of the public health law is amended by adding a new subdivision 4 to read as follows: 4. THE COMMISSIONER IS HEREBY AUTHORIZED TO PROMULGATE RULES AND REGU- LATIONS NECESSARY TO REQUIRE CHAIN PHARMACIES TO OPERATE DRUG DISPOSAL SITES FOR UNUSED CONTROLLED SUBSTANCES IN EACH COUNTY OF THE STATE, PROVIDED SUCH CHAIN PHARMACY HAS A PHARMACY LOCATED IN A COUNTY. FOR THE PURPOSES OF THIS SUBDIVISION, "CHAIN PHARMACY" MEANS A PHARMACY WITH MORE THAN TWENTY LOCATIONS IN THE STATE. § 2. This act shall take effect immediately.
