BILL NUMBER: S3947 TITLE OF BILL : An act to amend the judiciary law, in relation to judges in the eighth judicial district PURPOSE : The purpose of this legislation is to limit, in the eighth judicial district, the number of judges that can be from any one county. SUMMARY OF PROVISIONS : Section 1: Subdivision 8 of section 140-a of the judiciary law is amended. Section 2: Sets forth the effective date. JUSTIFICATION : The eighth judicial district is composed of the following counties: Chautauqua, Cattaraugus, Orleans, Genesee, Allegany, Niagara, Wyoming, and Erie, and has twenty-six judges. This legislation would restrict to twenty-two, the number of judges that could come from any one county. This restriction would allow counties with a smaller population the ability to elect judges to the judicial district. LEGISLATIVE HISTORY :

YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the judiciary law, in relation to judges in the eighth judicial district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 140-a of the judiciary law, as amended by chapter 500 of the laws of 1982, is amended to read as follows: 8. Eighth district, twenty-six, PROVIDED THAT THERE SHALL BE NO MORE THAN TWENTY-TWO JUDGES FROM ANY ONE COUNTY WITHIN SUCH DISTRICT; § 2. This act shall take effect immediately and shall apply to judges elected after such effective date.
