BILL NUMBER: S4202 TITLE OF BILL : An act to amend the election law, in relation to affidavit ballots PURPOSE : To establish a timely processing of provisional ballots following an election. SUMMARY OF PROVISIONS : Adds a new section 8-318 to the election law. EXISTING LAW : None. JUSTIFICATION : The need for standard procedures in processing and counting provisional ballots is necessary to assure the public that provisional ballots cast in an election are canvassed in a timely and orderly fashion. The state board shall establish standards to protect the security, confidentiality and integrity of those votes cast by means other than traditional machine voting. Recent state elections have shown that due to no established procedures for the timely processing and counting of certain ballots, interested parties may delay the

DILAN -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to affidavit ballots THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The election law is amended by adding a new section 8-318 to read as follows: § 8-318. AFFIDAVIT BALLOTS. THE STATE BOARD OF ELECTIONS SHALL ESTAB- LISH REASONABLE PROCEDURES TO ASSURE THE TIMELY PROCESSING AND COUNTING OF AFFIDAVIT BALLOTS, INCLUDING: 1. STANDARDS FOR TIMELY PROCESSING AND COUNTING TO ASSURE THAT, AFTER THE CONCLUSION OF THE AFFIDAVIT VOTE COUNT, PARTIES AND CANDIDATES MAY HAVE FULL, TIMELY, AND EFFECTIVE RECOURSE TO THE RECOUNT AND CONTEST PROCEDURES; AND 2. STANDARDS FOR THE INFORMED PARTICIPATION OF CANDIDATES AND PARTIES SUCH AS ARE CONSISTENT WITH REASONABLE PROCEDURES TO PROTECT THE SECURI- TY, CONFIDENTIALITY, AND INTEGRITY OF PERSONAL INFORMATION COLLECTED IN THE COURSE OF THE PROCESSING AND COUNTING OF AFFIDAVIT BALLOTS. § 2.
