   printed to be committed to the Committee on Higher Education
 
 AN ACT to amend the education law, in relation to establishing an  auto-
   matic application system
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  The education law is amended by adding a new part  6    to
 article 3 to read as follows:
                                  PART VI
                       AUTOMATIC APPLICATION PROGRAM
 SECTION 190. AUTOMATIC APPLICATION PROGRAM; ESTABLISHED.
         191. PROGRAM REQUIREMENTS.
         192. DATA PUBLICATION.
         193. PROGRAM PROMOTION.
         194. RULEMAKING AUTHORITY.
   §  190.  AUTOMATIC  APPLICATION  PROGRAM; ESTABLISHED. THERE IS HEREBY
 ESTABLISHED AN AUTOMATIC APPLICATION PROGRAM TO BE ADMINISTERED  BY  THE
 DEPARTMENT.
   § 191. PROGRAM REQUIREMENTS. 1. THE DEPARTMENT SHALL PROMULGATE STAND-
 ARDS FOR THE AUTOMATIC APPLICATION OF GRADUATING HIGH SCHOOL STUDENTS IN
 NEW  YORK  STATE  THAT COMPLY WITH THE FEDERAL FAMILY EDUCATIONAL RIGHTS
 AND PRIVACY ACT.   NO PERSONAL  INFORMATION  SHALL  BE  SHARED  WITH  AN
 EXTERNAL  ENTITY  WITHOUT  THE  EXPRESS  CONSENT  FROM  A STUDENT HAVING
 ATTAINED THE AGE OF EIGHTEEN OR, IN THE CASE OF STUDENTS SEVENTEEN YEARS
 OF AGE OR YOUNGER, PARENTAL CONSENT.
   2. IT SHALL BE THE RESPONSIBILITY OF  THE  DEPARTMENT  TO  CREATE  AND
 MAINTAIN A CENTRALIZED ACADEMIC DATABASE:
   (A)  TO PROVIDE AN ONLINE ACCOUNT FOR EACH STUDENT IN THE BEGINNING OF
 THEIR SENIOR YEAR OF HIGH SCHOOL THROUGH WHICH STUDENTS  MAY  APPLY  FOR
 ADMISSION  INTO THE STATE UNIVERSITY OF NEW YORK AND THE CITY UNIVERSITY
 OF NEW YORK;
