BILL NUMBER: S4480 TITLE OF BILL : An act to amend the public health law, in relation to tinting on motor vehicles PURPOSE OR GENERAL IDEA OF BILL : To expressly include Polymorphous Light Eruption among the list of medical conditions that may be considered for tinted window exemptions. SUMMARY OF SPECIFIC PROVISIONS : Section 1: Amends subdivision 12-a of section 375 of the vehicle and traffic law to include Polymorphous Light Eruption, Porphyia, Xeroderma Pigmentosa, and severe drug photo-sensitivity, as well as other medical conditions as determined by the commissioner of health pursuant to Public Health Law section 206, subdivision 16, as medical exemptions for window tinting. Section 2: Amends subdivision 16 section 206 of the Public Health Law to expressly include Polymorphous Light Eruption, Porphyia, Xeroderma Pigmentosa, and severe drug photo-sensitivity among the conditions listed by the commissioner of the department of health in relation to subdivision 12-a of section 375 of the vehicle and traffic law.

VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to tinting on motor vehicles THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 16 of section 206 of the public health law, as added by chapter 135 of the laws of 1994, is amended to read as follows: 16. The commissioner, in consultation with the commissioner of the department of motor vehicles, shall promulgate rules and regulations specifying the medical conditions based on health and safety which justify granting an exception to the requirements of subparagraphs one and two of paragraph (b) of subdivision twelve-a of section three hundred seventy-five of the vehicle and traffic law. SUCH MEDICAL CONDI- TIONS, SHALL INCLUDE, BUT NOT BE LIMITED TO, POLYMORPHOUS LIGHT ERUPTION, PORPHYIA, XERODERMA PIGMENTOSA, AND SEVERE DRUG PHOTO-SENSI- TIVITY. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09686-01-7
