BILL NUMBER: S5193 TITLE OF BILL : An act to amend the real property tax law, in relation to establishing a real property tax exemption for veterans who have a one hundred percent service connected disability SUMMARY OF PROVISIONS : Section 1 amends the real property tax law by allowing local governments to pass a total real property tax exemption for veterans who have a 100% service connected disability rating. Section 2 sets forth the effective date. JUSTIFICATION : New York is currently one of the only states in the nation without a real property tax exemption of some kind for veterans with a 100% service connected disability rating. The Federal Department of Veterans' Affairs suggests that there is more than 400,000 of these individuals nationwide. These veterans are those who have, in the service of our country, given almost everything - the Federal Government defines this category

MARCHIONE -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT to amend the real property tax law, in relation to establishing a real property tax exemption for veterans who have a one hundred percent service connected disability THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 458 of the real property tax law is amended by adding a new subdivision 3-a to read as follows: 3-A. REAL PROPERTY OWNED BY A DISABLED VETERAN WHO HAS A ONE HUNDRED PERCENT SERVICE CONNECTED DISABILITY SHALL BE DEEMED FULLY EXEMPT FROM TAXATION OF SUCH PROPERTY FOR CITY, VILLAGE, TOWN, COUNTY OR SCHOOL DISTRICT PURPOSES, PROVIDED THAT THE GOVERNING BODY OF A CITY, VILLAGE, TOWN, COUNTY OR SCHOOL DISTRICT, AFTER A PUBLIC HEARING, ADOPTS A LOCAL LAW, ORDINANCE OR RESOLUTION PROVIDING THEREFOR. § 2.
