BILL NUMBER: S5254 TITLE OF BILL : An act to amend the civil service law, in relation to permitting temporary appointments to certain positions for a period not to exceed thirty-six months PURPOSE OF THE BILL : This bill would amend the Civil Service Law ("CSL") to permit appointments to temporary positions established to conduct a special project or study for a period not to exceed thirty-six months. SUMMARY OF PROVISIONS : Section 1 of the bill would amend CSL § 64(3) to provide that the Department of Civil Service or municipal commission having jurisdiction may, in exceptional cases, authorize a temporary appointment without examination when the person appointed will render professional, scientific, technical or other expert services on an occasional basis or on a full-time or part-time basis in a temporary position established to conduct a special study or project for a period not to exceed thirty-six months. Section 2 of the bill would make it effective immediately. JUSTIFICATION :

GOLDEN -- (at request of the Department of Civil Service) -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the civil service law, in relation to permitting tempo- rary appointments to certain positions for a period not to exceed thirty-six months THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 64 of the civil service law, as added by chapter 626 of the laws of 1960, is amended to read as follows: 3. Temporary appointments without examination in exceptional cases. Notwithstanding the provisions of subdivisions one and two of this section, the civil service department or municipal commission having jurisdiction may authorize a temporary appointment, without examination, when the person appointed will render professional, scientific, techni- cal or other expert services (1) on an occasional basis or (2) on a full-time or regular part-time basis in a temporary position established to conduct a special study or project for a period not exceeding [eigh- teen] THIRTY-SIX months. Such appointment may be authorized only in a case where, because of the nature of the services to be rendered and the temporary or occasional character of such services, it would not be practicable to hold an examination of any kind. § 2.
