BILL NUMBER: S5285 TITLE OF BILL : An act to amend the not-for-profit corporation law, in relation to the creation of a land bank in Livingston county PURPOSE : To increase the number of land banks that can be established pursuant to the NYS not-for-profit corporation law. SUMMARY OF PROVISIONS : This bill amends paragraph(g)of section 1603 of the not-for-profit corporation law to increase the number of land banks in New York State from 20 to 21. JUSTIFICATION : The New York State land bank program (Article 16 of the not-for-profit corporation law) was established by law in 2011 to help alleviate the problems faced by communities that have experienced an increase in the number of blighted, abandoned, and tax delinquent buildings. The program is intended to return ownership of these buildings to a land bank which constitutes a not for profit corporation formed by a municipality. YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend the not-for-profit corporation law, in relation to the creation of a land bank in Livingston county THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (g) of section 1603 of the not-for-profit corpo- ration law, as amended by chapter 106 of the laws of 2014, is amended to read as follows: (g) Nothing in this article shall be construed to authorize the exist- ence of more than [twenty] TWENTY-ONE land banks located in the state at one time, PROVIDED, HOWEVER, THAT ONE SUCH LAND BANK SHALL BE CREATED IN THE COUNTY OF LIVINGSTON, provided further that each foreclosing govern- mental unit or units proposing to create a land bank shall submit such local law, ordinance or resolution as required by paragraph (a) of this section, to the urban development corporation, for its review and approval. The creation of a land bank shall be conditioned upon approval of the urban development corporation. § 2. This act shall take effect immediately.
